2022年高考全国甲卷语文作文题取材于《红楼梦》。在“大观园试才题对额”中，众人争相为园中亭子题名，有清客直接移用欧阳修名篇《醉翁亭记》中的“翼然”二字作为匾名。这让笔者联想到从著作权角度进行思考：在现实中，“直接移用”行为是否必然会侵犯著作权?

直接移用的表达可能不构成作品，不侵犯著作权

直接移用的内容可能并非“作者”独自创作。在现实中，如果直接移用的内容并非前人“独自创作”的作品，此时直接移用行为并不会侵犯他人著作权。比如，某服饰公司参考清代短褂上的图案设计出了波浪花边旗袍，于是其要求出售同款旗袍的经营者承担著作权侵权责任。最终法院认为旗袍上的波浪花边图案不具有独创性，不构成作品，进而被告未侵犯原告的著作权。
