He investigates complaints large and small that come to him from all levels of society. As complaints must be made in writing, the Ombudsman receives an average of 1, 200 letters a year. He has eight lawyer assistants to help him and he examines every single letter in detail. There is nothing secretive about the Ombudsmans work, for his correspondence is open to public inspection. If a citizens complaint is justified, the Ombudsman will act on his behalf. The action he takes varies according to the nature of the complaint. He may gently reprimand an official or even suggest to parliament that a law be altered. The following case is a typical example of the Ombudsmans work.

A foreigner living in a Swedish village wrote to the Ombudsman complaining that he had been ill-treated by the police, simply because he was a foreigner. There was nothing in tthe record to show that the foreigners complaint was justified and the Chief of Police strongly denied the accusation. 数千亩黑土地遭央企污染绝收六旬老人维权16年

因环保部的点名通报，原本堆放在428.6亩土地上的电石渣刚刚被转移到了厂区内部。而事实上，环保部的要求是在2016年年底前将厂区内的电石渣清理处置完毕。

从法律受助者变成法律援助者，王恩林成了当地有名的“土律师”，帮不懂法的村民维权打官司。中国青年报·中青在线记者 何林璘/摄

为了村里被污染的数千亩土地，仅有小学三年级文化水平的黑龙江省齐齐哈尔市农民王恩林，用16年时间与齐齐哈尔化工集团有限公司(以下简称“齐化集团”)作斗争。

微信头像里的王恩林是二十几岁的样子。这张翻拍的黑白证件照里的年轻人，有着浓黑的眉毛，高高的颧骨，典型山东汉子的模样。随父亲从“闯”到漫天飞雪的齐齐哈尔，从包干土建工程到承包卡车运输，他曾是榆树屯村的第一个万元户。

如今，他是村里“最没钱”的维权代表。“如果没有污染，我肯定还是我们村里的大富翁!”坐在村里月租50元的40平方米的平房里，王恩林咧嘴一笑。

在2016年12月底之前的十余年间，一座由齐化集团堆放的电石渣场形成的白色“山丘”，始终是榆树屯村的“地标”。5米多高的“山丘”在阳光下亮得刺眼。

离428.6亩电石渣场不远处，是一片2900多亩的水池，村里人称之为“大水泡”。四五米深的水泡，一眼望到底，湛蓝得与天空同色，却几乎看不到鱼、鸟和草。村民形容“啥活物都看不着，静得吓人”。

对王恩林来说，16年前的春节至今记忆犹新。

2001年农历大年三十，正聚在炕上打牌、包饺子的王恩林和周围村民发现，他们的房子被淹了。零下30摄氏度的低温下，几百米外，齐化集团工厂排出的工业废水冒着热气漫进了屋里，“年都没过好”。

也正是这一年，齐化集团将聚氯乙烯项目扩大到年产8万吨，每生产1万吨聚氯乙烯，排放废渣量约1.5万~2万吨。废渣和浆产生量相应增加，开始和这个村子抢夺并不宽裕的耕地。

2001年春节的那场工厂废水外溢实际仅淹了1亩多地。中国青年报·中青在线记者获得的一份齐齐哈尔昂昂溪区委会议纪要显示，2001年4月24日召开的区长办公会议确定，被淹没的土地“长久不能利用”。

但让村民不解的是，这次会议不仅没有谈及赔偿，还“为了配合和支持企业生产”，同意该村与企业达成协议，在被淹1亩地的基础上，再划出428亩土地“租”给齐化集团，用来堆放“对土地造成污染”的废渣，协议租期27年。

如今寸草不生的大水泡曾是村里的一等田。1948年，齐化集团建厂后便将该水泡作为纳污水体。1988年，齐化集团征用榆树屯村450亩耕地及844.4亩草原，在没有任何防渗措施的情况下继续用于排放污水。

这个协议书上称共计1294.4亩的水泡面积，在1993年昂昂溪区土地管理局颁发的《国有土地使用证》上，却变成了2972.7亩。

每提及被污染的土地面积数字，王恩林都一字一顿地读到最后一个数字。

“根据1987年的《中华人民共和国土地管理法》第二十五条，县级人民政府只有批准耕地3亩、其他土地10亩的权力，这个土地证属于昂昂溪区土地管理局违规签发!”这位仅有小学文化的泥瓦匠说。

2001年，齐齐哈尔市国土资源局收到了一封匿名举报信——信中称榆树屯村有428亩土地被违规用来堆放工业废渣。这是王恩林第一次为村里的土地“出头”，他用圆珠笔在一页草稿纸上歪歪扭扭地写出事情缘由，塞进齐市国土资源局局长办公室的门缝里后撒腿就跑。

“那时候还不敢署名，怕被报复。”让王恩林没想到的是，2002年7月，齐齐哈尔市国土资源局对齐化集团租用428.6亩土地排污构成违法用地一事予以处罚，责令该集团补办临时用地审批手续，并处以30万元罚款。

但罚款未改变428.6亩土地被用于排污的现实。如今15年过去，该集团仍未办理临时用地审批手续。

齐化集团前员工向记者透露，当时的齐化集团在齐市属于纳税大户。截至2005年，齐化集团已连续8年成为该市纳税第一大户和特级安全企业，2004年缴纳的税金就高达1.3498亿元。

绝收

“根本不用施肥，种上就能得果!茄子油黑油黑的，番茄红得发亮!”说起以前自家屋前的黑土地，王恩林挥舞着手不停地比画，脸兴奋得通红。

因“一五”“二五”时期的集中投入，齐齐哈尔一度是国家重点发展的重工业基地。位于榆树屯村的齐化集团正是该市以大中型国有企业为骨干、以重化工业为主体的大工业格局中的重要一环。

粗放的重工业车轮碾压下，是被忽视的惨重环境代价。

记者从昂昂溪区环保局了解到，1970年到1989年间，齐化集团采用汞法制碱，每年向水泡子排放60万吨污水，其中含汞0.53吨，致使水泡子中平均含汞浓度为每升0.09~0.16毫克。1989年以后，排污量进一步增加至每年140万吨。

村民眼见着齐化集团将电石灰水和电石渣排放到没有任何防渗措施的428亩堆场，最深处达25米。呈碱性的电石渣不仅影响堆场地的土质，还会对周边土地产生影响。

村民最初并不知道，伴随工厂废水流入同样毫无防渗措施的水泡子，污染早已通过地下水在村里蔓延。

2007年，齐化集团被列入环保黑名单。这家于2005年并入中国化工集团的齐化工厂因治污设施未正常运行，成为国家环保总局该年第一批挂牌督办的环境违法案件，一度被叫停整改。2008年，齐化集团停产，中国化工集团在附近新建厂房，改名为黑龙江昊华化工有限公司。

但污染造成的影响已无法挽回。

2000年后，王恩林承包的7亩土地和侄子王占胜的约30亩土地开始出现减产。

靠近大水泡和电石渣堆场的地方，曾让王占胜自豪到腰杆儿笔直的25亩“一等田”再也长不出苗。据2012年榆树屯村村委会开具的一份介绍信显示，王占胜的30亩地种了三茬都没长苗。种子没变，肥料没变，但水土已不是以前的水土。好不容易长出的玉米秸秆，像营养不良的孩子佝偻着腰，结出的极少数玉米棒不到一巴掌长。

村民董景阳不甘心，他不信以前那么好的地就“这么废”了。在不出苗的第四年，他仍尝试在耕地的高岗地上种了两茬庄稼，结果依然颗粒无收。

如今的榆树屯村已看不出昔日工业兴盛时的模样。白雪覆盖的上千亩土地，看不出秧苗生长的痕迹。

让王恩林痛心疾首的是，在无地可种的榆树屯村，人们被迫出走。原本近3000人的村子，如今剩下不到一半人口，留下的多是老人、妇女和孩子，被化工厂带来的污染“驱赶”到日渐减少的耕地上——从6000亩减到5000亩，再减到4000亩。

曾有媒体公开报道，2011年黑龙江省用全国约十分之一的耕地生产出全国四分之一的商品粮，养活了全国约六分之一的人口。在这片不断向外输出粮食的肥沃土地上，像王恩林一样失去原本肥沃土地的人，并不在少数。

2014年4月，官方公布的首次全国土壤污染状况调查公报显示：全国有高达16.1%的耕地土壤污染超标，表层土壤中无机污染物含量增加比较显著。其中，土壤污染问题较为突出的就包括东北老工业基地。

面对数千亩减产绝收的土地，“没办法”“认栽”“打不赢央企”是村民的普遍态度。但倔脾气的王恩林却不以为然。

“土地养了我们，可它不会说话啊，得有人替它争这口气!”王恩林义愤填膺。

维权

“你说工厂污染了土地，你有证据吗?”最初因耕地污染与当地政府部门交涉时，王恩林不断被官员反问这样的问题。

“村里那么高的电石渣堆，几千亩的良田种不出苗，不就是最直接的证据吗?”王恩林说。

他走了很多弯路。不止一次，国家信访局将王恩林等人的上访诉求转办到黑龙江省，省里再转到市里，市里再转到区里，区里又转回了村委会。“村干部得意地跟我说：‘你们上哪儿告都没用，怎么告最后都会转回我们手上。’”

“我只知道我有理，但不知道对方到底哪里违法，有没有证据。”王恩林说。

为此，王恩林开始“死磕”法律。火炕边狭窄的桌上摆着数十本法律书籍：《侵权责任法配套解读与案例注释》《民事诉讼法典》《最新损害赔偿法律适用大全》《物权法》《民法通则》……炕头的《新华字典》被翻遍了形。

在用上智能手机之前，王恩林有钱时买书，没钱时就在书店“泡”上一天，偷偷抄下要用的法条，跑去复印店打印。为表示感谢，王恩林拎着一麻袋新鲜的玉米棒送给昂昂溪区法律书店的店员。

王恩林把和政府部门交涉称之为“打架”，“是打嘴架，用法律武器‘打’!”王恩林家里堆成山的证据材料，“几乎都是靠他‘打架’打来的”。

为了拿到土质被污染的证据，王恩林曾多次向当地环保部门提出检测污染数据的要求，但始终没有回音。他不断往返于黑龙江省环保厅、齐齐哈尔市环保局、昂昂溪区环保局等各部门。

面对推脱，王恩林质问：“《中华人民共和国环境保护法》第十条有规定，县级以上地方人民政府环境保护主管部门，对本行政区域环境保护工作实施统一监督管理。为什么你们连个检测都不给我们做?”

2014年4月，在黑龙江省环保厅的要求下，齐齐哈尔市环境监测中心站终于对水泡子的水质和底泥进行检测，检测结果显示，底泥的总汞含量达1.6mg/Kg，PH值高达9.2。

王恩林对《土地管理法》的相关条款几乎倒背如流。为证明当时村委会将428.6亩土地转租给齐化集团长达27年涉嫌违法，2009年王恩林多次向有关部门申请查询本村的土地规划和使用现状图，遭到工作人员百般阻挠。他仔细查阅《物权法》并熟记在心：“《物权法》第十八条有明确规定权利人、利害关系人可以申请查询、复制登记资料，登记机构应当提供。国土资源部2002年就制定了土地登记资料公开查询办法!你们为什么不让我们查?”

对方被问得哑口无言，《1997年~2010年榆树屯乡土地利用总体规划图》《榆树屯土地利用现状图》两份证据才如愿获得。

昂昂溪区的政府官员都知道王恩林不好糊弄。“我们不懂法的人，经常被政府几句话唬弄过去了，因为听他们说的话，你虽然一方面觉得他说得不对，但另一方面又找不出他什么毛病。但老王不是，一般人唬不住他。”村民王宝琴说。

每次去“打架”前，王恩林随身携带的包里总要放上相关的法律书籍，“防止对方耍赖，当场查阅对证，有备无患”。在一场有关428.6亩电石渣堆场的座谈会上，王恩林一人与昂昂溪区多个政府部门负责人座谈。座谈中王恩林多次提及村内有大面积草原未经村民同意便被变更用途、开垦为耕地。

一名官员笑着说：“老王!你不懂啊!这草原就是我们国家的，不是你们的!所有草原都是我们国家的，你们没权管!”

“领导您这么说不对!”王恩林当场表示不服气，“草原虽然是国有的，但根据《中华人民共和国草原法》第十三条规定，集体所有的草原或者依法确定给集体经济组织使用的国家所有的草原由本集体经济组织以外的单位或者个人承包经营的，必须经本集体经济组织成员的村民会议三分之二以上成员或者三分之二以上村民代表的同意!我们村的草原其实是我们村集体使用和保护的!”

但事情并没有王恩林想象的那么顺利。

他一度以为，污染事实如此清楚，短则几个月，长则一两年就能解决。没想到案子一拖就是16年。

尽管大量耕地出现明显减产，甚至绝收，当地农业部门却始终拒绝提供书面官方鉴定结果，并拒绝向记者作出回应。

在8年时间里，王恩林都被当地法院以“诉讼主体资格不够”等理由不予立案。

他百思不解：“我们符合《民事诉讼法》第一百零八条，诉讼有明确的被告，有具体的诉讼请求，没有违法的地方，为什么不给我们立案?”王恩林说，“就算不给立案，也至少该我们一份书面的不立案裁决。可他们什么都不给，明明法律规定7天是回复期限，为什么我们这么多证据都不能被接受?”

如今，王恩林自己也说不清到底为何坚持这么久。

有村民质疑他是“为了钱”。但事实上，一审昂昂溪区人民法院判决齐化集团赔偿55户农民共计的82万元，平均每户不到两万元。而王恩林为了讨要一张证据，来回的车费、住宿费、律师费、材料费等就至少花费1万元。

对这个干泥瓦匠出身的农民来说，“做事就像盖房子一样，要有始有终”。

为了打官司，王恩林放弃了原来的生意，靠儿子一家接济。并不富裕的家庭几乎被王恩林这些年的“执着”拧干。

儿子王占凯提起父亲，一脸的无奈和钦佩，他不是没想过劝父亲放弃，但“劝也没用啊!我爸他就是那钻进牛角尖的孙悟空，非要把尖给钻破了才出来!”

王宝琴、吴宝春、杨振青、李殿奎、杜彦强、董景阳……和王恩林一样看不惯耕地被毁的十几个老人陆续加入到维权的队伍中。

“我们这是个‘老年环保队’。平均年龄60多岁，年龄总和接近1000岁，学历水平总和却超不出高中水平。”王宝琴自嘲。

年复一年，这帮“老家伙”在跟时间赛跑。

在白天不足8小时的齐齐哈尔冬天，7个老人约着凌晨4点集合，搭着吴宝春的二手五菱面包车，赶在政府上班前去“堵门”。

王恩林呼吸时从肺部发出嘶嘶声，重度肺结核曾折磨他3年，但官司一直没撂下。

最早和王恩林一起打官司的宋希平去世了。去世的前一晚，宋希平还在和王恩林通电话：“老王你再写一份村里违规开垦草原的材料，我明天交到法院去!”

和王恩林同年的吕生，电话里问候的第一句永远是“老三，最近身体咋样”，之后再问案子进展。“没他不行啊，他是我们的法律顾问!这案子没他早就黄了。”
