为了比较死刑冤案的赔偿数额，我查阅了世界其他地方的一些规则和事例，结果情况相当参差多样。美国是西方少有的保留死刑国家(50个州有31个保留死刑，但过去40年间，全国每年平均执行死刑36人)，对于冤狱赔偿，各州立法以及判例都参差不齐。由于从判决到执行往往经年累月，所以在美国不少死刑错判是在漫长的上诉以及等待执行过程中发现的。这样，绝大多数赔偿都发生在死刑犯还活着的时候。一起被广泛报道的案例是，一位名叫德斯柯维奇(Jeffrey Mark Deskovic)的纽约男子，16岁时被控性侵、暴打和掐死一位15岁的女同学，他被定罪判刑入狱，坐了15年冤狱，后经DNA测试证明他是冤枉的，重获自由后他到法院状告警察并胜诉，获4100多万美元(约合人民币2.5亿元)的赔偿。人未死，尚可获得如此数额的赔偿，如果执行了死刑，可以推定赔偿数额应该更高。

当然，从各州规定的政府赔偿数额而言，美国许多州的标准算不得很高。那里最大赔偿的可能性——如德斯柯维奇案所显示的那样——来自于对于警察当局所提起的侵权赔偿。在无从对警察当局提起侵权之诉的地方，国家赔偿的数额的确定是否应该将警察以及司法过错的损害包含在其中呢?

在台湾发生的一起死刑冤案可以提供参考。1996年一位空军士兵江国庆因屈打成招，被军事法院以强奸杀人罪于次年判处并执行死刑。这位“台版聂树斌”也是因为真凶出现而得到昭雪。台湾司法机关在发现真凶后迅速审理，宣布江国庆无罪的同时，判决国家赔偿新台币一亿元(约合人民币2169.76万元)。值得注意的是，台湾司法机关在判断赔偿数额时，精神赔偿之外，又引入平均寿命的标准。跟聂树斌一样，江国庆冤死时也是21岁，依照台湾男子76岁——大陆是74岁——的平均寿命，计算他预期的年收入，如此所得的数额具有相当的合理性。

综上所述，我的看法是，假如聂家人无法对造成这起错杀冤狱的执法机关提起侵权之诉(依据现行法律，此类诉讼可以提起，但尚无先例)，考虑到本案的巨大冤屈、国家司法机关严重的推诿和掩盖罪行以及长达11年痛苦的伸冤经历，聂家人理应获得合理的赔偿，1391万元不为过。
