Nobody could have failed to notice the fact that drunken driving has been a grave problem with which we are confronted. 事实上，拿贪官获刑来类比，是很好辩驳的，贪官获刑起点设置，本身就备受诟病，是亟需修正，拿一个本身就存在病态的事物来类比，这不是要比坏吗?更值得关注的是，法理依据念兹在兹，为何还会有人对这些判例觉得错愕甚至不能接受呢?以此事件为例，正如有论者所言，对公众来说，抓到十几只鸟卖出一千多块钱，就要入狱十年半?这种行为与后果之间的落差是寻常观念所难以接受的。

而之所以心生如此疑虑，原因又在于二：首先是对案情的有偏向地获取，比如简单地理解为“抓了几只鸟”，然后再在先入为主的影响下，搬出“保护野生动物的价值认可度并不高”的托词。但实际情况是，这个大学生并非一时顽劣，而是对所抓的鸟有清晰的了解，并且参与到捕猎、收购、倒卖整个环节中，据说他还是“河南鹰猎兴趣交流群”的一员。换句话说，这个大学生的“抓鸟”行为，从最朴素的原始情感出发，这至少不是值得原谅的无心之举。

而再回到现代法治社会的语境之下，保护野生动物的意识或许是个普遍存在的问题，但是，当我们以立法之名，对野生动物进行保护时，无论是从法律实施目标，还是从法律精神的层面来讲，所要恪守的应该是严厉的“罪刑法定”原则。既然刑法中已经对破坏野生动物做出了罪行设置，那么刑法的威严就应得到最大程度的尊重，用法律专业术语说，也就是刑罚的确定性。

当然，当我们热烈地强调让“道德归道德，法律归法律”，但这并不妨碍我们对法律宽严相济和谦抑性的热忱欢迎。事实上，“一律入刑”，并非不容分说的一刀切，它可以在法定刑责的基础上，根据事实和证据，讲梯度、分轻重、论区别，真正实现罪行责的相适应。

如果大学生“抓鸟入刑十年”，这种抓到一个算一个的威慑建构，在现阶段让人难以接受，那也是我们不得不接受的普法之重。在法律之威严面前，断然是不能以保护意识不强、公众心理上难以接受来“法外开恩”。它最终不仅无益于野生动物的保护，更是对法治文明的亵渎。

The two pictures show some problems in the present education system in China. In the poor countryside, especially in some western parts of China, the education is also poor. They are sometimes forced to leave their studies because their families cannot afford the necessary fees. However, the situation is totally different in the cities. Given the problems above, our government has taken some measures. “The Hope Project” has been in operation to ensure that children in the poor areas can achieve education. Zhang Dong is my best friend. He is a boy. Both of us are good at English, so we often have a chat in English in our spare time. Besides,football is our favourite sport.
