每年春节，对于孩子来说是最未欢天喜地的日子。也是大人们疯狂掏钱的日子!孩子们一个正月下来，赚的压死钱多则高达爸妈一年的收入，少则一个月的收入!仔细算来，孩子的压岁钱也的确不是小数目!可是，这笔钱由谁来掌管?而且每年春节期间，围绕压岁钱归属权、使用权，孩子与家长之间少不了引发一场场大战来。而如今，对于孩子的压岁钱已演变成家长与家长间的变相馈赠，多少存在礼尚往来性质，家长可以让孩子理解这层含义。虽然压岁钱是给孩子的，作为监护人，家长有权帮助孩子管理、支配。即便如此孩子表现出的抗议其实更多是在争取自己权利，渴望从大人那里得到更多支配权。

或者说，对于家长可以适当放权，比如放开压岁钱使用权，将大份资金作为教育理财资金，告诉孩子这是他今后的教育费用，小份交由孩子自己管理，同时约法三章，使用要经过父母同意。但凡是愿意将压岁钱交给父母保管的，大都集中在小学生和初中生，很多孩子和父母事先已经协商好了，有的全额上交，有的留下部分“余款”。针对压岁钱一事，一般来说较好的做法就是孩子跟父母协商好了，压岁钱是别人给她的，所属权归她，这些钱父母不能乱拿。

因此，在每年的压岁钱她都会按照一定的比例分成两份，一份存在银行卡里，这里面的钱谁都不能动，毕竟孩子的压岁钱的管理关系到孩子对钱财的认知，如果家长和孩子沟通不到位，会伤害孩子的自尊心。特别是针对孩子的压岁钱，父母及家长应从小对孩子进行教育并制定相关的管理制度，告诉孩子他拥有使用压岁钱的权利。 此外就是在在管理孩子的压岁钱上，应该根据孩子的年龄段区别对待。

当然，在对于孩子们“发横财”的机会，而不少家长却队孩子手里的巨额压岁钱犯了愁，孩子拿到了钱该不该收?其实，对于孩子的压岁钱重要的是背后的“情”，父母及家长对孩子的压岁钱，应该有“不强求”、“不放手”，父母要抓住机会对孩子做好家庭责任、成就感培养教育。家长应从小引导孩子，压岁钱并不是暴富的途径，而是一种传统礼节。过多的资金容易助长孩子不劳而获心理，未劳动就获得一大笔钱，会让孩子觉得赚钱很容易，不利于养成节俭习惯。

不过，此前就有关于父母及家长给孩子发“红包”属于赠与性质，与孩子之间形成的是赠与合同关系，“红包”一经孩子接受，赠与合同就依法成立，如果家长没收孩子的压岁钱，可就算违法了都。根据我国合同法第一百八十五条的规定，赠与合同是赠与人将自己的财产无偿给与受赠人，受赠人表示接受赠与的合同。但是孩子作为无民事行为能力人或者限制民事行为能力人，接受了他人的赠与，即表示其对赠与物享有所有权。因此，孩子对压岁钱享有的是所有权。父母对孩子的财产具保管义务，但凡不是为了被监护人(即孩子)的利益而处分其财产的行为都是违法行为。

但如果说，孩子尚小不懂得如何处理压岁钱，不妨将此情况讲明，引导小孩将之理解为一种“礼尚往来”的风俗，并自愿上交压岁钱的好习惯。如果小孩已经十多岁了，并懂得在压岁钱的问题上与父母较劲或已经发生过不愉快了，父母尽量避免不愉快的事情发生，如果强制没收容易给孩子造成理财的消极心理，对孩子的社会心理发展是不利的。根据中华人民共和国民法通则第十八条第一款规定，监护人应当履行监护职责，保护被监护人的人身、财产及其他合法权益，除为被监护人的利益外，不得处理被监护人的财产。

另外就是根据中华人民共和国民法通则第一百三十三条规定，有财产的无民事行为能力人、限制民事行为能力人造成他人损害的，从本人财产中支付赔偿费用，不足部分，由监护人适当赔偿。换言之，出于对孩子的利益考虑，如为孩子投商业保险，让孩子参加业余学习等情况，可以动用孩子财产。孩子到了一定年纪，对事物有一定认知能力时，即使出于孩子利益考虑，还是有必要告诉孩子财产的处理情况。对于那些还不能很好地独立使用压岁钱的孩子，家长可以暂时帮他们保管压岁钱，但要教孩子如何规划这笔钱。可以和孩子讨论一下压岁钱怎么花最有意义，传授孩子正确的理财观念，让孩子做好准备后，再逐步放开其对压岁钱的支配权。诸如此类。

besides, once a child is born, he should be guaranteed the very best his parents could offer. in poor families, wouldnt the children, who are taed be regarded as burdens by other family members because theyve imposed more economic pressures on their families? the ta also directly deprives his or her rights to grow up in a better economic condition while such deprivation to a child in a wealthy family doesnt have much influence at all.

the taes on birth policy is, after all, gentle to the rich and tough to the poor, especially to the taed children in poor families. thus, it is not worth so much recommendation.
