As for the former, the advantages of it seem to be very apparent, which of

共享单车横空出世之后，关于共享单车驶入机动车道、随意停放、被肆意破坏、据为己有等问题已多有报道和评论。针对管理失序，笔者曾撰写评论《共享单车，需以自治保卫自己》提醒各经营公司重视管理失序问题，尽快达成行业自治，约束企业和用户行为，避免政府直接干预。此次深圳湾共享单车拥堵现象，再次暴露出管理秩序问题。如果失序现象持续，不排除有政府干预或者立法干预的可能。

“共享单车挤爆深圳湾”的新闻一出，几位朋友即表示这是典型的公地悲剧。即资源免费享用或者接近于免费时会出现大量的搭便车现象，搭便车行为虽然是理性的，然而大量搭便车行为会因资源枯竭而导致所有人利益受损。共享单车本身使用价格低廉、停放方便，而深圳湾又是市区内最适宜骑行的免费公园，使用共享单车的人贪图一时方便却使得交通堵塞，其外部性损害了自己及其他人的利益，整体福利下降。

在有关“公地悲剧”、“公共池塘”的博弈论研究中，学者们特别突出的是利益相关人如何通过契约实现自治，他们的研究均假设所有人都是理性人，他们的行为均依交易成本来计算和选择。在多数“共享单车挤爆深圳湾”的评论中，“加强管理”、“加强政府对经营企业的监督”、“骑共享单车的人素质差”是使用频率最多的表述。“加强管理”、“加强政府对经营企业的监督”这两个表述意思很清楚，后一个表述“骑共享单车的人素质差”隐含的意思也是要加强对使用人的管理。几乎没有评论指向“契约与自治”。

笔者反感某些专家学者不认真研究一般理论却急于提出如何解决问题的对策。人的行为是理性的利己的，公园是免费的，共享单车是廉价又方便的，若不从行业自律、使用者约束角度探讨一般行为，所有的公共资源都会陷入悲剧，拟或难以摆脱被动接受政府管制的命运。在“共享单车挤爆深圳湾”事件报道之前，去年底深圳湾等公园便已多次反映共享单车的随意停放问题，当时并没有引起太多的重视。公园管理方和单车经营企业均未能预判到假日期间共享单车随意停放导致的交通拥堵后果。

共享单车挤爆深圳湾将问题彻底暴露出来。笔者认为，管理失序主要原因是使用共享单车的契约存在缺陷，次要原因是经营企业管理效率低。公园是开放的资源，资源枯竭的根源在于消费者没有节制的搭便车行为。共享单车市场投放，不能仅追求以投放数量抢占市场份额进而获取投资者青睐，或者图谋上市圈钱。而应在抢占份额时学习如何更好地利用契约实现有序竞争和资源共享。这其中包含两个关键契约：一是经营企业之间的行业规范，二是企业与用户之间的约定。前者意在约束恶意竞争行为，后者意在约束用户行为。发生在深圳湾的共享单车事件，主要是后者存在契约缺陷，即用户行为未能通过契约得到有效约束，特别是对用户不规范停车行为缺乏有效的惩戒措施。有专家提出，企业应适当加强对用户的信用管理，深圳交警也表示要将共享单车使用者的行为纳入信用记录，这些提法都值得参考，但似乎没有物质惩罚来得直接有效。

在深圳这30多年的发展历程中，我们可以看到政府与市场关系的演变，也可以看到企业社会的成长。企业社会承载了许多社会功能，除了向社会供应各种商品外，也扮演着企业公民的角色参与社会建设。政府的制度安排与管制并不能解决所有的秩序问题，企业在促进社会秩序方面应起到日益重要的作用，其中如何促进社会的契约精神至为关键。“共享单车挤爆深圳湾”不过是给经营企业和用户上了一课，通过这件事学习如何以契约约束自己的行为、如何以契约促进秩序、如何以契约实现自治。

针对这种现象，摩拜单车甚至配合政府制定了相应的罚款措施，严重的会拘留3个月。

另外，许许多多的公司如雨后春笋，成批量生产共享单车，这也是造成单车紊乱的原因之一。对此，政府部门做出了以下举措：只有政府发放牌照，共享单车才能继续运营，否则一律算作违法。这从源头上遏制了共享单车的野蛮生长。我们也要协助政府，加强对共享单车的管理。

最近，我看到的一则新闻使我欣慰：郑州的一个小伙，专门把被乱放的单车搬回停放点，还特地建立了一个QQ群，号召好友一起行动。对此，单车管理员表示：“我原来还以为他是来偷车的，后来了解了情况后，我真的很感谢他，希望大家也能够自觉停放好单车，方便别人，也方便自己……”

现在，我们的社会有了共享书店，共享篮球等等，无一不是在朝着共享的目标而努力。我们的社会正在发展，我们每个人都应该跟上时代的步伐，早日达到真正的“共享”，早日达到真正的共产主义社会！

Nowadays, more and more people realize the harm of smoking and the damage

smoking, I have some suggestions. First of all, people should have strong will

on giving up smoking. Personal determination is the most important factor. When

feeling eager to smoke, people should think about the damage of smoking and the

people they love. And then they can strengthen their will not to smoke.

Secondly, sweep away all the cigarette around. They can’t find any cigarette

when they want to smoke. And then after a while, their wants for smoke will

reduce gradually. Last but not least, prepare some candies in the pocket, when

people want to smoke, eat candies instead. Hope every smoker succeed in the

end.

There is nothing complicated about eating a proper diet. For good health,

eat a variety of foods. Do not eat the same foods day after day! Foods should be

selected everyday from each of basic four. They are the four groups of food

essential to proper nutrition: the milk group, meat group, vegetable-fruit

group, and bread- cereal group, Your body will then be supplied with all the

nutrients it requires; they are water, minerals, carbohydrate, fats and oils,

proteins, and vitamins. A persons diet is determined by his attitudes, likes

and dislikes. If you eat foods from each of the basic four groups each day, you

will have a balanced diet.
