在高中生活的最后一年中，我忙里偷闲看了《我是歌手》几乎所有的比赛，因为我舍不得放弃那让我震撼的一场场表演。在这些歌手中，有的是朋友，有的是合作关系，但在比赛中却没有因任何原因而有丝毫懈怠。他们每一次都会精心选歌，重新编曲，为了追求完美通宵熬夜更是每个歌手都曾经历过的，甚至邓紫棋、张宇、“动力火车”都曾困为过分练歌而唱哑了嗓子。我想也正是因为每一个歌手都认真地对待比赛，才会让每一场演出让人那么期待，能让人看到新的东西，让人震撼。正是因为他们全力以赴地竞争，才让他们越来越被观众所喜爱，才让节目越来越火，才给观众留下许多美好的记忆。所以说，竞争使比赛有了意义，有了竞争比赛才完美。

对于我们学生来说，考试就是比赛。在平时的学习和生活中，我们相互帮助，一起研究不懂的知识，在薄弱的科目上相巨帮助，但此时，在考场上，我们彼此之间在竞争，都在尽自已所能把最好的一面展示在试卷上，只为了能够赢得这场比赛，而不是故意隐藏实力或传纸条之类的，因为我们知道全力以赴地完成这场比赛是对高考的尊重。

As we all know, there are three stages in studypreview, study in class and review, among whichreview is the most important. From my experience, Id like to talk about the importance andsteps of review. 后来，大猫的渔网升级为渔网2.0版，捉的鱼也多了不少，猫儿们的生活也慢慢好起来了。他们渐渐习惯了这种张嘴便有鱼吃的生活，也对大猫充满了感激之情，而在大猫到来之后出生的猫仔仔们更是不知道自己打渔的生活是什么样的，只是觉得大猫叔叔太帅了。大猫的威望越来越高。

不知不觉中，大猫的木棚子变成了小石屋，又变成了水泥小楼，最后变成了小洋房。猫儿们看到这些，觉得大猫跟以前有一点不一样了，但是也没有多说什么。

再后来，大猫不再把全部鱼分给猫儿们，而是把其中的一大部分在自己家的地窖里藏了起来。猫儿们知道这件事后有些不开心。于是大猫悄悄叫来了猫群中与他关系比较好的那些猫猫，塞给了他们很多鱼，于是这些猫猫有的成为了大猫家的保镖，有的连夜写了《大猫歌》，有的编了《大猫日报》，有的混在乘凉聊天的猫猫堆里装作不经意地提起大猫的种种好处，于是猫群里充满了赞美大猫的声音。

但是大猫地窖里的鱼越囤越多越囤越多，于是有的猫猫开始分不到鱼了。但他们只是叹息自己命不好，然后忧伤地舔舔自己的毛和爪子。

终于有一天，有一只年轻的穷猫猫决定学捉老鼠吃。

“老鼠!老鼠怎么能吃!”其他猫猫大惊失色。

“如果不学会吃老鼠，以后一点鱼都吃不到了该怎么办?”穷猫猫说。

但是其他猫猫都觉得他很可笑：“怎么会没鱼吃?大猫会给我们的呀。”

后来有的穷猫猫饿得实在受不了了，想自己去海边捉鱼吃，但一来他们已经忘掉潮水涨落规律等祖祖辈辈留下的经验，二来大猫在海岸边设置了很多关卡不让其他猫猫接近，有的猫猫偷偷到了海边，却被大猫手下的猫卫兵们抓走了，再也没有回来。

大猫建立了巨大的城堡，在海边筑起了高大围墙。后来他不给穷猫猫们分鱼了。

穷猫猫们却忘了这片海岸原来是属于他们的。他们很绝望。

或许有一天，学捉老鼠的年轻猫儿们会回来，带着猫儿们砸掉大猫城堡。

也许他们已经被猫卫兵捉完消失了。

2022年高考全国甲卷语文作文题取材于《红楼梦》。在“大观园试才题对额”中，众人争相为园中亭子题名，有清客直接移用欧阳修名篇《醉翁亭记》中的“翼然”二字作为匾名。这让笔者联想到从著作权角度进行思考：在现实中，“直接移用”行为是否必然会侵犯著作权?

直接移用的表达可能不构成作品，不侵犯著作权

直接移用的内容可能并非“作者”独自创作。在现实中，如果直接移用的内容并非前人“独自创作”的作品，此时直接移用行为并不会侵犯他人著作权。比如，某服饰公司参考清代短褂上的图案设计出了波浪花边旗袍，于是其要求出售同款旗袍的经营者承担著作权侵权责任。最终法院认为旗袍上的波浪花边图案不具有独创性，不构成作品，进而被告未侵犯原告的著作权。

表达过于简单，往往不构成作品。独创性不但要求作品源于作者本人，还要求达到一定的智力创造水准。具体而言，一方面，构成作品的表达应当体现作者独特的取舍、选择与安排。“翼然”二字在《醉翁亭记》中意为“像鸟张开翅膀一样”，生动形象地展现出亭子四角翘起的模样。这一表达是欧阳修进行创造性劳动而产生的成果。另一方面，具体表达不能过于简短。与法国以作品方式保护作品的标题不同，我国司法实践通常不认为名称、标题等词语或短语满足独创性要求。因此，对于过于简短的表达，即便其高度凝结了创作者的个人智慧，类似直接移用“翼然”二字的创作行为通常并不会侵犯著作权。

They think some shows confuse the lines between entertainment and life.The producers know their audiences are young, so they should realize that teens watching "reality" shows might not be ableto tell the difference between fantasy and fiction.

Opposing voices have also come from others. They think that they use the media--magazines, television and movies--to connect to one another and to the world, so naturally,theyre influenced by the images the media present. Nevertheless, those teens hold that the media only provide information, what they as viewers do with that knowledge is up to themselves.
