邱小平：解决拖欠农民工工资问题，事关广大农民工切身利益，事关社会公平正义和社会和谐稳定。近年来，经过各地区、各有关部门共同努力，拖欠农民工工资问题总体得到遏制，但目前仍未得到根治，特别是受经济下行压力增大、部分企业生产经营困难等因素影响，一些地区还有所反弹，少数地区甚至因拖欠农民工工资引发了群体性事件和极端事件。由此可见，保障农民工工资支付形势依然严峻，任务十分艰巨。

对此，党中央、国务院高度重视。党的十八大和十八届三中、四中、五中全会都明确提出，要保护劳动所得，健全工资支付保障机制。去年政府工作报告明确要求全面治理拖欠农民工工资问题，这次国务院办公厅印发《关于全面治理拖欠农民工工资问题的意见》，是贯彻落实党中央、国务院部署要求的举措，目的是从根本上解决拖欠农民工工资问题。

问：造成拖欠农民工工资问题的原因是什么?

邱小平：从各地反映的情况来看，当前拖欠农民工工资问题仍主要发生在工程建设领域，同时，加工制造、采矿等各行业拖欠农民工工资案件逐步增多。导致拖欠农民工工资问题的原因主要有：一是建设领域市场秩序不规范。工程项目违法分包、层层转包、挂靠承包、垫资施工和拖欠工程款等问题仍大量存在，无用工主体资格的“包工头”带队伍参加施工的现象比较普遍，导致建设单位与农民工之间形成了很长的“债务链”，工资支付的责任主体难以落实。二是建设领域用工管理和工资支付行为不规范。施工企业普遍采取平时只给农民工发基本生活费，工程竣工后或春节前结清工资等做法，将农民工工资与工程款捆绑在一起，一旦工程款不到位极易导致欠薪。同时，农民工劳动合同签订率低、流动性大，使农民工在追讨工资时往往缺乏证据。三是当前一些劳动密集型加工制造业、煤炭等行业的企业生产经营遇到困难，逐步成为新的欠薪风险源。四是保障工资支付的法律制度仍不健全。工资保证金等制度执行刚性不足，发挥作用不到位。企业拖欠工资的违法成本过低，最高罚款不超过2万元，与用人单位动辄数百万甚至上千万的拖欠工资数额相比，不足以起到震慑作用。

邱小平：近年来，各地区、各有关部门和单位认真贯彻落实党中央、国务院的部署要求，不断加大农民工工资支付保障力度，主要做法有：一是探索实行工资保证金、欠薪应急周转金和建筑总承包企业负责解决分包企业欠薪责任制等制度、办法。二是加强农民工工资支付情况监察执法，在畅通举报投诉渠道、开展日常巡视检查的基础上，每年岁末年初，人力资源社会保障部门联合有关部门开展农民工工资支付情况专项检查，加强对重点行业的排查和监控。同时，加大涉及农民工报酬争议的处理力度。三是健全劳动保障行政监察执法和刑事司法衔接机制，加大对欠薪犯罪行为的打击力度。四是加强综合治理，建立部门联动机制。

问：《意见》的主要任务是什么?

邱小平：《意见》紧紧围绕保护农民工劳动所得，坚持标本兼治、综合治理，着力规范工资支付行为、优化市场环境、强化监管责任，健全预防和解决拖欠农民工工资问题的长效机制。《意见》提出，以建筑市政、交通、水利等工程建设领域和劳动密集型加工制造、餐饮服务等易发生拖欠工资问题的行业为重点，健全源头预防、动态监管、失信惩戒相结合的制度保障体系，完善市场主体自律、政府依法监管、社会协同监督、司法联动惩处的工作体系。到2020年，形成制度完备、责任落实、监管有力的治理格局，使拖欠农民工工资问题得到根本遏制，努力实现基本无拖欠。

问：《意见》针对拖欠工资问题突出的工程建设领域采取了哪些有效措施?

邱小平：《意见》坚持以问题为导向，既兼顾其他行业企业，又以治理工程建设领域拖欠农民工工资问题为重点，从用工管理、工资发放、资金拨付、保障制度、项目管理等环节予以规范，提出了有针对性的政策措施。一是针对用工管理和工资支付行为不规范问题，进一步明确要落实各类企业包括建设领域施工企业依法按月足额支付工资的主体责任，强调施工总承包企业对所承包工程项目的农民工工资支付负总责;要求在工程建设领域坚持先签劳动合同后进场施工，全面实行农民工实名制管理制度，施工总承包企业要加强对分包企业劳动用工和工资发放的监督管理，不得以包代管;推行银行代发工资制度，鼓励实行分包企业农民工工资委托施工总承包企业直接代发的办法。二是针对一些企业工资支付主体责任难落实问题，要求健全工资支付监控和保障制度。其中，针对现实中工程款与农民工工资往往捆绑在一起的问题，为保证工程款中的人工费不被挪作他用，在总结一些地方经验基础上，特别提出要建立健全农民工工资(劳务费)专用账户管理制度，推动农民工工资与工程材料款等相分离，要求建设单位在拨付工程款时，按照合同约定的比例或施工总承包企业提供的数额，将工程款中的人工费用单独拨付到施工总承包企业在银行设立的农民工工资(劳务费)专用账户，确保专款专用;针对工程款拨付不到位等导致的欠薪问题，明确了建设单位或施工总承包企业的清偿责任。三是针对企业拖欠工资违法成本低的问题，要求严厉查处拖欠工资行为，对恶意欠薪涉嫌犯罪的，依法追究刑事责任。同时，要求完善企业守法诚信管理制度，建立拖欠工资企业“黑名单”制度，建立健全企业失信联合惩戒机制，使失信企业在全国范围内“一处违法、处处受限”。四是针对建设领域市场秩序不规范问题，提出加强建设资金监管、规范工程款支付和结算行为、改革工程建设领域用工方式等政策措施，从源头上预防和减少拖欠工资问题。

问：《意见》将如何组织实施好，确保政策措施落实到位?

邱小平：解决拖欠农民工工资问题涉及面广、政策性强、难度很大，必须依靠各级政府高度重视，统一领导，统筹协调，才能确保各项政策措施落到实处。为此，《意见》提出，一要按照属地管理、分级负责、谁主管谁负责的原则，完善并落实解决拖欠农民工工资问题省级人民政府负总责、市(地)县人民政府具体负责的工作体制，落实属地政府监管责任。要求各地政府完善目标责任制度，建立定期督查制度，健全问责制度等。二要进一步健全解决企业拖欠工资问题联席会议制度，形成治理欠薪工作合力。在中央层面建立由人力资源社会保障部、发展改革委等12个部门和单位组成的联席会议制度。在地方层面，要求地方各级人民政府建立健全由政府负责人牵头、相关部门参与的工作协调机制。此外，《意见》还提出，要加快健全工资支付保障相关立法，加大普法宣传力度，为维护农民工劳动报酬权益提供法治保障。

The environment has been polluted badly today and the nature punishes the

human being by all kinds of disasters, such as the heavy haze in Beijing, which

damages people’s health. World Environment Day is on June 5th. It pays attention

一般村民的孩子每天吃两餐、每餐平均分量较多，然而因为孩子长期营养不良，肠胃没办法一次消化吸收那么多食物，因此多吃的部分无益。反而每天吃四餐、每餐平均分量较少，孩子长得比较好。

此外，一般村民相信，孩子知道自己有多饿，一大锅饭菜端出来，全家人各取所需。但是高壮的孩子的妈妈，会先把他们的饭菜分出来，确保孩子吃得饱。遇到生病等特殊情况，妈妈还会一口一口喂孩子吃完饭。
