该专家表示，按照现行劳动法规规定，“用人单位由于生产经营需要，经与工会和劳动者协商后可以延长工作时间，一般每日不得超过一小时;因特殊原因需要延长工作时间的，在保障劳动者身体健康的条件下延长工作时间每日不得超过三小时，但是每月不得超过三十六小时。”

“如果劳动者选择在这个中秋、十一的9天假期全部加班，是明显违反劳动法规定的每个月36小时的上限规定，“而且无论员工是否同意是否自愿，超过法定加班时间的行为都是违法的。”

“从保护劳动者休息权的角度，一是企业不能强迫劳动者加班，要合理安排工作时间，还有劳动者也要为自己的身心健康着想，不能一味加班。”该专家表示，用人单位在9天假期当中有安排加班的话，应该根据相关规定支付加班费，也可以安排调休，保障劳动者的权益。如果劳动者的加班工资被克扣或者被迫超时加班，可以直接向劳动保障监察部门反映，或通过拨打电话12333进行举报。

“而且无论员工是否同意，超过法定加班时间的行为都是违法的。”一位律师也表示，在法律允许的范围内，用人单位安排劳动者加班必须履行法定程序。而违反法律、行政法规的劳动合同属无效劳动合同，无效劳动合同则没有法律约束力。所以，不管双方是否愿意，超时加班都是违法的。

About 3:00PM I get to the destination---shiqi shiyan xiaoxue where she is a vice president .When I get to this place .I feel comfortable(My dream is to be a teacher) while I meet her .My teascher is get older. That is life. And then some exciting is brush to me. This sence is unexplained. We talk about life, work, love & future. From this talking I sincerely know everyone has his life. I know if I want to success I need pay twice or even more hard work. My teacher give me some advice too . Everything is change, the matter is that the change is to be good or bad. WORK HARD TANDTX---I SAY TO MYSELF.

At 5.00PM I’m on my way to the hometown---Xianjiao. This evening I go on practicing.

National Day!

今天是国庆节。我们没有课。早上,我去了人民公园与我的母亲。我们有一个美好的时光。在下午,我帮助我的父母做晚饭。今天我有一个忙碌的一天。

10月。2004星期五阳光明媚

今天是国庆节,但我不感到任何快乐,只是没有理智。昨晚我下载英文论文直到3点,有时我想放弃。但为了完成我的梦想。我可以处理它。

国庆节!

Im taking a long vacation this week.Although the weather is bad,I’m still taking a vacation.I want to do something interesting.I heard that Mount Yandang is a good place to have fun.So Im thinking about going to Mount Yandang.I really want to go with my classmates.And its exciting for me to go camping.I hope I finish my homework early.Im leaving on Thursday and staying until Saturday.Im taking a walk,going fishing,going bike riding and so on.I hope I can forget all my problems!A great vacation,I cant wait!

Today is October 1st, the annual National Day again.

National Day seven days off, some people traveling to some rest at home, they are also in a shu Lin, it is difficult to come out. Early in the morning I and my mother went shopping, I saw on the street is crowded, people as the tide came from all directions on the street, many places with flags, flags fluttering with the wind, beautiful. 今天是十月一日，一年一度的国庆节又到了。

国庆节放七天长假，有的人外出旅游去了，有的人在家里休息，有的人则还在一片书林中，难以走出来。一大早我就和妈妈去逛街了，只见马路上是人山人海，人们如潮水般地从四面八方来到了大街上，许多地方插着彩旗，彩旗随风飘动着，漂亮极了。到处呈现出节日里热闹的气氛。

每次我过生日的时候，爸爸、妈妈都祝愿我能健康、快乐的成长。今天是祖国母亲的生日，我祝愿祖国繁荣昌盛，越来越强大。

我还要提醒大家：过节日的时候人多车也多，过马路的时候一定要注意安全，而且还要做到红灯停，绿灯行。

Today is National day,but I don’t feel any happy at all,just no reson.Last

night I download the English Paper till 3AM ,sometime I want to give up.but in

order to accomplish my dream.I can handle it.

This afternoon I go to shiqi to visit a respectful teacher.On the way to

shiqi,the street don’t crowd .I think it would be full of crowd of people in

Festival.perhaps personal travel is encouraged at present.
