2022年高考全国甲卷语文作文题取材于《红楼梦》。在“大观园试才题对额”中，众人争相为园中亭子题名，有清客直接移用欧阳修名篇《醉翁亭记》中的“翼然”二字作为匾名。这让笔者联想到从著作权角度进行思考：在现实中，“直接移用”行为是否必然会侵犯著作权?

直接移用的表达可能不构成作品，不侵犯著作权

直接移用的内容可能并非“作者”独自创作。在现实中，如果直接移用的内容并非前人“独自创作”的作品，此时直接移用行为并不会侵犯他人著作权。比如，某服饰公司参考清代短褂上的图案设计出了波浪花边旗袍，于是其要求出售同款旗袍的经营者承担著作权侵权责任。最终法院认为旗袍上的波浪花边图案不具有独创性，不构成作品，进而被告未侵犯原告的著作权。

表达过于简单，往往不构成作品。独创性不但要求作品源于作者本人，还要求达到一定的智力创造水准。具体而言，一方面，构成作品的表达应当体现作者独特的取舍、选择与安排。“翼然”二字在《醉翁亭记》中意为“像鸟张开翅膀一样”，生动形象地展现出亭子四角翘起的模样。这一表达是欧阳修进行创造性劳动而产生的成果。另一方面，具体表达不能过于简短。与法国以作品方式保护作品的标题不同，我国司法实践通常不认为名称、标题等词语或短语满足独创性要求。因此，对于过于简短的表达，即便其高度凝结了创作者的个人智慧，类似直接移用“翼然”二字的创作行为通常并不会侵犯著作权。

直接移用在先作品侵权与否判定需结合具体情况

移用在先作品中非独创性部分的，不侵犯著作权。构成作品并不意味着作品的全部内容均具有独创性。文学作品中除具体的文字组合、遣词造句外，还包括背景设定、主题题材、主线情节及人物之间的关系。背景与题材具有抽象概括性，一般认为属于思想范畴，不能受到《著作权法》保护。主线情节是否具有独创性则需要具体问题具体分析，在文学的发展历程中，大量的情节模板属于公有领域的内容，如果直接移用的是不具有独创性的情节，则不构成著作权侵权。我国《著作权法》的立法宗旨在于鼓励作品创作和传播，因此《著作权法》对作品的保护不会延及作品中的思想和非独创性部分，这些内容属于社会共同财富。

直接移用的表达与在先作品的独创性部分构成实质性相似的，构成著作权侵权。实质性相似判断包括“实质性”认定和“相似”对比两大部分。“实质性”内容是指能够基本展现作品核心内容，且能够体现作者独特个性的独创性部分。因此，在进行侵权比对时，首先需要剔除公有领域部分和他人在先表达，以此过滤出具有独创性的表达。“相似”包括相同和近似，如果在后内容包含在先作品足够具体的独创性表达，且相似内容达到一定数量、比例，则可以认定与在先作品构成实质性相似。若与在先作品相比，相似部分所占比例不高，但从普通观察者视角而言，足以感知到在后内容来源于在先作品，二者在精华部分高度相似，则也可以认定构成实质性相似，从而构成著作权侵权。

总而言之，社会公众应当尊重创新，但这并不意味着在创作时畏首畏尾，不敢移用前人之作。在不超过适当比例且符合学术规范的前提下，且整体上不与在先作品核心部分构成实质性相似，通常是合法的，不会侵犯他人著作权。

深蓝色的天空中雄鹰展翅，飞鸟齐鸣，他们宣告着自己跨越人生后的无限感慨……

我是一只鹰，深褐的羽毛已经十分厚实了，覆盖着身上的每一寸肌肤，在阳光下光亮照人。母亲说我应该学会飞翔，尝试自己新的人生，所以，今天，我独自连飞带蹦地来到了这片山从中最高的巅峰。

云似白色烟雾一样缠绕在周围，从未想过原来山顶别胜一片天啊!今天，我要跨越一个新的人生阶段，学会真正的飞翔!

俯首看向脚下，千万朵云交接得毫无缝隙，触着凉凉的，似水一般的清幽。远处是无数山峰夹杂着春的暖意，不曾想第一次看到这姹紫嫣红竟如此壮观，风中透着馨香与馥香，合成一道委婉的丁香般女子的气息。

抬头便是深邃的天空，似乎时光亘古不变，它一直肃静着，似没有帆的无浪的海平面，永远不见涨潮的迹象。我就是要飞到哪儿吗?它是如此永恒，如此庄严。

站久了，腿开始发抖，我似乎并不敢飞了，我害怕柔弱的烟云后是遍地的荆棘，我惶恐永恒的天空中是无尽的空洞。泪水不禁决堤，风鞭打着泪水在脸庞冲击，火辣辣的难受。

跨越，必须要跨越吗?

是的，心里是十分肯定的回音。任风吹乱了羽毛，我想象着穿过云层后瞬间滑落，然后在万籁俱寂的惊恐中在地上绽成一朵血红的玫瑰，但我用生命下了一个自以为不会赢的赌注。

纵身一跃，跨越了云层。

我开始无力地往下坠，展开翅膀，用力挥舞，任凭翅膀在风的阻力发出惨痛的骨头断裂声，依旧不屈不饶。上升了上升了，我终于使自己在空中平稳飞行了，我飞向了梦寐以求的天空。

一丈跨越，我跨越了断崖，跨越了云层，更跨越了人生。跨越，只需奋力一搏，你会发现人生在转角绽放得更加灿烂。

空中一直雄鹰在舞蹈，尽管血不但穿过尘埃滴在草地上，但它仍旧不屈不饶，因为跨越后，他不再奔跑。
