综观各国食品安全监管的发展历程，并非在其最初级阶段就存在如此多样的监管模式。由于食品种类的多样性和食品安全问题的复杂性，在食品安全监管之初，各国往往采取的是多部门分工监管的模式，尽量减少单个部门的工作压力，提高食品安全监管的质量。然而随着食品生产工艺的复杂化、社会化日益加强，一种食品“从农田到餐桌”涉及到多个环节，而将这些环节的监管工作人为地割裂开来，会导致食品安全的监管脱节、重复和冲突等诸多问题。因此到二十世纪末，各国纷纷对食品安全监管体制的设立进行了重构，因各国立法背景的不同，基本形成了以上前三种监管体制模式。从食品安全监管的历史发展可以看出，食品安全监管体制的设立呈由分散到统一的趋势。

二、我国食品安全监管体系中的一些问题

1、从1949年至今，我国部级以上机关所颁布的有关食品安全方面的法律、法规、规章、司法解释以及各类规范性文件等多达840篇。由由此可见我国食品安全标准制度繁多。它们之间有交叉、重复，又有空白，所以多种标准在市场上往来冲突，缺乏协调机制。正因为这些标准存在多头监管，实际上就造成了“多部门管不好一张餐桌”的局面，容易出现一些监管的“真空地带”，出了问题，又互相推诿。

美国、日本等发达国家十分重视标准的研究与制定工作，如：美国政府每年以7亿美元的经费支持标准的研究与制定;日本1999年6月至2001年9月投资数亿日元，历时2年3个月完成了日本标准化发展战略的制定任务。我国虽然制定了一系列有关食品安全的标准，但许多标准标龄过长，缺乏科学性与可操作性，在技术内容方面与WTO有关协定和CAC标准存在较大差距。早在20世纪80年代初，英、法、德等国家采用国际标准已达80%，日本国家标准有90%以上采用国际标准，发达国家目前采用国家标准面更广，某些标准甚至高于现行CAC标准水平。而我国国家标准仅40%左右等同采用或等效采用了国际标准，食品行业国家标准的采标率只有14.63%。

2、我国食品检测机构目前还由政府监管，民营自主检测意识低。资料显示，我国的食品相关检测的技术机构5 630家(在世上是绝无仅有的)，从业总人数达到15.04万人，其中直接从事食品检测的为3.74万人。大专、大学以上学历的人员数量接近总从业人数的50%。但是在食品流通领域，2006年国家公布的检测机构仅仅176家(国家计量认证许可)，远远不能满足我国的食品检测需求。并且食源性(生物性与化学性)危害是目前我国食品安全的主要问题，而我国现在缺乏食源性危害的系统监测与评价背景资料。我国目前尚缺乏定点主动监测网络，而往往是出现事故后再进行控制。没有对引起中毒事件中常见的重要致病菌进行危险性评价的背景资料。

3、缺乏高新的检测技术，关键检测技术与设备落后。比如，在农药残留检测方面，美国食品药品管理局(FDA)的多残留方法可检测360多种农药，德国可检测325种农药，加拿大多残留检测方法可检测251种农药; 而我国缺乏同时测定上百种农药的多残留分析技术。出口时只能依靠国外的检验机构检测，完全丧失了进出口贸易中的主动性。

新产品安全性评估欠缺。与发达国家相比，我国在采用新技术、新工艺、新资源加工食品的安全性研究与评估方面存在较大差距。例如，欧美发达国家对食品工业用菌的管理和审批非常严格，对菌种的使用历史、分类鉴定、耐药性、遗传稳定性、有效性等都有明确的要求并建立了数据库，建立了完善的菌种档案和安全性评价、检验方法，而我国多年来传统食品发酵中使用的一直是大量未经检验和科学性评价的菌种。另外，我国对一些新型食品添加剂、包装材料、酶制剂以及转基因食品的安全性问题缺乏研究与评估。

4、食品行业及政府部门有关工作人员社会道德与责任心问题 食品安全保障这根链条还存在着政府、监督机构、消费者以及媒体等诸多环节。有些企业心存侥幸，唯利是图，以牺牲消费者利益为代价，结果最后只能是害人又害己。近几年曝光的阜阳“大头娃娃事件”、“三鹿奶粉事件”等就是很好的例子。在维护食品安全方面，一向被视为弱势群体的消费者也肩负着捍卫自身利益的责任，社会举报便是一条很重要的途径，但是当前群众举报较少，相当多的消费者认为价格便宜的食品问题不值得举报。这就存在观念问题。此外，在少数地区，地方政府和官员为了政绩，把打假工作与发展经济对立起来，担心打假会影响地方经济发展，出现了“地方保护主义”。

去年出现的“三鹿奶粉事件”在我国已不是首例食品安全事件。在它之前的食品安全事件发生以后至多是舆论的一阵谴责，然后就是不了了之，食品药品安全问题积累的太多的诟病，一直无法从根本上解决。

通过看其他国家的食品安全体系发展历程我发现，每个国家都出现过向我们现在类似的情况，因此我认为也不必要太过于敏感与消极。虽说食品与药品行业是所谓的“良心行业”，但我认为主要支配地位的还是体制问题，而体制不完善，法律不健全，归到底还是技术和经济因素。例如，美国在19世纪中期直至20世纪初的很长一段时间里，也曾由于缺乏统一的法律和专门的机构负责打击假冒伪劣商品，市场上掺假食品和劣质假药泛滥，公众健康受到严重侵害。

当一个国家发展到一定程度，制度完善时，优势就会显现出来。反应停(沙利度胺)最早于1956年在原西德上市，主要治疗妊娠呕吐反应由于临床疗效明显而迅速流行，而在美国，由于该药因资料不足，未获FDA审查通过。结果在全球出现上万例新生儿畸形时，美国能幸免。这就是著名的“沙利度胺不良反应事件”，又叫做“反应停事件”。这向我们证明证明，企业集团从来都不具有维护公众利益的内在自觉性，为了谋求企业的最大利润总是不惜牺牲公众的健康和安全。即便是出现了“反应停”这样严重的药害事件，企业集团仍然会极力维护其自身利益。企业守法的自觉性只能来自于其违法行为所必须承担的风险和代价。必须通过强有力的依法监管，通过对违法行为的打击和惩处，迫使企业将国家的法律规范转化为企业的自觉行动。

由于我尚学识浅薄，只是能看到当今神会问题的这一部分，更难以提出什么实质性的解决办法，但我相信随着社会的进步，制度会完善，人们也会有更有效的行为规范，从而让我国食品行业有发展的更好的保障。

For another thing， the countrys regulatory regime is inadequate， so that criminals can take advantage of the opportunity.

Food safety is very important. If you eat unsafe food， the consequences would be unthinkable. Therefore， we should take some measures to prevent unsafe food.

First of all， the government should strengthen supervision and improve the law to punish illegal food manufacturers. furthermore， when consumers buy food should depends on its production date and shelf-life. In short， to solve the food security issues need a long way to go， it needs the joint efforts of all sides.
