日前，北京中关村二小“欺凌事件”经网络发酵，引发社会热议。学校、家长和社会对此事是否是“校园欺凌”存在分歧。

史卫忠介绍，从近期检察机关办理的案件情况来看，未成年人涉案罪名相对集中，主要集中在故意伤害、寻衅滋事、抢劫、聚众斗殴等几类。在校园欺凌和校园暴力涉案主体方面，中学生在涉罪未成年人中占比较高。在作案手法上，作案动机的简单性和突发性明显，拉帮结派、恃强凌弱现象较为突出。

2016年12月，一篇名为《每对母子都是生死之交，我要陪他向校园霸凌说NO!》的文章在网络上流传，让校园欺凌再次受到热议。

最高检通报，2016年1月至11月，全国检察机关共受理提请批准逮捕的校园涉嫌欺凌和暴力犯罪案件1881人;受理移送审查起诉3697人。但从“两高”公布的统计数据可以看出，真正进入司法程序被追究法律责任的人并不多。“校园霸凌”在法律上仍然存在盲区。

对校园欺凌的界定，是一个需要审慎思量的问题。而这个问题，亟待社会、学校、政府来作答。“建议上海尽快邀请第三方专业人士，完成对校园欺凌的界定，同时尽快启动上海校园欺凌专项普查。”上海市两会上政协委员朱建国、陈永亮将在2017年两会期间递交此提案。

除了将惩处的各个环节都纳入法治和制度框架以外，学校应该承担起预防的责任。有委员提出，面对“校园欺凌”，学校需要从心理、行为等方面开设相关课程，将“校园霸凌”扼杀在萌芽期。
