一年一度的高考已落下帷幕，但人们关于语文作文的讨论依旧热情不减。其中，高考全国甲卷作文引用《红楼梦》中“大观园试才题对额”情节命题，笔者认为，不妨从版权角度对其进行解读。

“为元妃(贾元春)省亲修建的大观园竣工后，众人给园中桥上亭子的匾额题名。有人主张从欧阳修《醉翁亭记》‘有亭翼然’一句中，取‘翼然’二字;贾政认为‘此亭压水而成’，题名‘还须偏于水’，主张从‘泻出于两峰之间’中拈出一个‘泻’字，有人即附和题为‘泻玉’;贾宝玉则觉得用‘沁芳’更为新雅，贾政点头默许。‘沁芳’二字，点出了花木映水的佳境，不落俗套，也契合元妃省亲之事，蕴藉含蓄，思虑周全。”从版权的角度细读题干，使人联想到作品创作过程。或直接移用，或借鉴化用，或根据情境独创，三种不同的创作方式有可能带来妙笔生花的文章、栩栩如生的画作、活泼立体的音像作品，但也有可能会面临不同的版权侵权风险。

但是现实中，这种直接移用的创作方式其实存在较大的版权侵权风险，如近期“北大满哥”控诉“小满”广告文案直接抄袭其早期发布的视频文案，又如短视频二次创作者直接将长视频剪辑成多个片段发布的“切片式”搬运行为，都是未经许可直接移用他人作品的案例，若没有合理使用、法定许可等抗辩事由，则涉嫌构成著作权侵权。

贾政主张从“泻出于两峰之间”拈出一个“泻”字，他人附和为“泻玉”，这种部分引用加入个人创作的借鉴化用方式在日常创作中最为常见，也极易产生版权侵权风险。

不可否认的是，创作通常要站在前人的肩膀上进行，但借鉴程度决定了其是否构成版权侵权。《著作权法》允许在创作中引用合理长度的作品片段，但不允许完全或主要以他人的作品代替自己创作的行为。

贾宝玉结合花木映水的佳境和元妃省亲的时事作出“沁芳亭”，并吟出“绕堤柳借三篙翠，隔岸花分一脉香”的对联，体现了贾宝玉的文学素养，也为后人展示了作品创作的条件和过程，即作品既要独立完成，也要体现一定的智力创造性。

那时候的我，被磨平了所有的棱角，失去了所有的锋芒，我变得非常自卑，并对生活不再抱有希望，甚至想到了退学。因为高考，我曾一度放弃了我最爱的写作，我很久不在键盘上敲字了，因为我所有的时间和精力都贡献给了高考，贡献给了为了越来越接近750分的梦想。但是我也只是想想罢了，累了就躲在房间的角落里，用被子蒙住头，大哭一场，哭完了擦干眼泪，继续前进。

我还记得班主任说：“哭就代表了懦弱，代表了屈服，代表了妥协。人生的路还长着呢，这点小挫折就把你打败了，那以后的路怎么走?”在我18岁生日的时候，没有蛋糕和鲜花，但我对着天空许了一个愿望，希望自己以后能够变得更加坚强。

于是我想：“难过也是一天，快乐也是一天，何不让自己快快乐乐地上学，放下一切压力与烦恼，轻装上阵?”我一直想做到宠辱不惊的境界，也在慢慢改变自己：发下卷子的第一件事不是去看自己的分数，而是看自己错在哪里;不是用泪水缓解心理上的压力，而是用理智寻找问题的根源。

周围的一切事物都没有发生变化，书还是那么厚，题还是那么多，钟表还在一圈又一圈地旋转，小黑板上倒计时的数字越来越少，我的心越来越安静平和。期末考试过后，毫无准备的我，在看到自己的名字赫然排在第一行的时候，泪水猝不及防地掉了下来。

那句话没有错——努力终会有回报，只是时间的长短不同罢了，其中的辛酸，饱含的泪水与汗水，只有我自己知道。

这样的状态一直保持到最后一次模拟考试，我满怀信心地上了真正的考场。我还记得考数学的那个下午，窗外漆黑一片，电闪雷鸣，教室的灯全部打开了，我在白炽灯下演算着并不是强项的数学题目，心突然乱了。

那年的数学考题，是前所未有的难。出了考场，雨停了，我的心却下起了小雨。为了不影响之后的几门科目，我快速地调整好心情，强颜欢笑。

等待结果是一个漫长的过程，当我颤抖着双手点下查询按钮时，3位数字出现在眼前，非常刺眼，我不敢相信。那真是有史以来最差的成绩，我的身体仿佛瞬间被冻住，心寒到了极点。

我将自己关在屋里，好几天没出门，饭也只吃很少的一点点。那摞堆在墙角的一米多高的有关高考的复习资料，被我一把推倒，我流下了失败者的泪水。

不知何时，父亲站在了我的身后，他只是轻轻地拍了拍我的肩膀，告诉我：“高考其实就是人生的一个缩影，有成功也有失败，有大起大落，有大悲大喜，有人哭就有人笑。结果并不重要，重要的是这样一个过程。只有真正经历过高考的人，才会将自己尚未成熟的心灵磨炼得更加坚强，才会有更强大的承受力，来经受今后人生道路上更多的挫折。”

我像一个跌倒的小孩，重新爬了起来。

上了大学之后，我才发现，是金子在哪里都会发光的。如果选择了努力，无论在哪里都会有收获;如果选择了堕落，即使在天堂，也终有一天会坠入地狱。

如今，我的大学路已经走了一半。很多时候我还会梦到那年的高三，梦到永远也做不完的卷子、永远也改不完的数学错题。突然，我非常怀念那个时候的充实和忙碌。和现在的迷茫、无所适从相比，我更愿意重新坐回高中毕业班的教室，和所有的人一样，为了一个确定的梦想奋斗。

那年高考的失败，现在谈起来，云淡风轻。那年高考带给我的，是我一生中最宝贵的财富。

感谢那年的高考，让我成长。

June 6th Thursday Sunny

This afternoon a young American friend called Mike came to our school. He visited our lab, library and school factory. At five oclock he had a free talk with some of my classmates. I was lucky to be one of them.

Mike spoke English slowly and carefully, so we could understand what he said. We talked about our English study for about an hour. Before he left our school, I asked him in English, "What do you think of our school?" He answered with a smile, "Oh, its wonderful!"

This is the first time for me to talk with a foreigner in English. English is really userful.
