《明晰边界方能拥抱百花齐放的创作空间》

一年一度的高考已落下帷幕，但人们关于语文作文的讨论依旧热情不减。其中，高考全国甲卷作文引用《红楼梦》中“大观园试才题对额”情节命题，笔者认为，不妨从版权角度对其进行解读。

“为元妃(贾元春)省亲修建的大观园竣工后，众人给园中桥上亭子的匾额题名。有人主张从欧阳修《醉翁亭记》‘有亭翼然’一句中，取‘翼然’二字;贾政认为‘此亭压水而成’，题名‘还须偏于水’，主张从‘泻出于两峰之间’中拈出一个‘泻’字，有人即附和题为‘泻玉’;贾宝玉则觉得用‘沁芳’更为新雅，贾政点头默许。‘沁芳’二字，点出了花木映水的佳境，不落俗套，也契合元妃省亲之事，蕴藉含蓄，思虑周全。”从版权的角度细读题干，使人联想到作品创作过程。或直接移用，或借鉴化用，或根据情境独创，三种不同的创作方式有可能带来妙笔生花的文章、栩栩如生的画作、活泼立体的音像作品，但也有可能会面临不同的版权侵权风险。

有人提到借用欧阳修《醉翁亭记》中的“翼然”二字，从现在的《著作权法》来看，“有亭翼然”只包含四个汉字，不足以体现其创新性，即不能构成作品，不能受到《著作权法》的保护;且在《红楼梦》中的故事发生时，《醉翁亭记》版权保护期已过，作品进入公有领域后无需授权即可被直接引用。

但是现实中，这种直接移用的创作方式其实存在较大的版权侵权风险，如近期“北大满哥”控诉“小满”广告文案直接抄袭其早期发布的视频文案，又如短视频二次创作者直接将长视频剪辑成多个片段发布的“切片式”搬运行为，都是未经许可直接移用他人作品的案例，若没有合理使用、法定许可等抗辩事由，则涉嫌构成著作权侵权。

贾政主张从“泻出于两峰之间”拈出一个“泻”字，他人附和为“泻玉”，这种部分引用加入个人创作的借鉴化用方式在日常创作中最为常见，也极易产生版权侵权风险。

不可否认的是，创作通常要站在前人的肩膀上进行，但借鉴程度决定了其是否构成版权侵权。《著作权法》允许在创作中引用合理长度的作品片段，但不允许完全或主要以他人的作品代替自己创作的行为。

贾宝玉结合花木映水的佳境和元妃省亲的时事作出“沁芳亭”，并吟出“绕堤柳借三篙翠，隔岸花分一脉香”的对联，体现了贾宝玉的文学素养，也为后人展示了作品创作的条件和过程，即作品既要独立完成，也要体现一定的智力创造性。

The year of 2008 is getting closer and closer to us. We need to take actions from now on to prepare for the game. What we need to do most is to work on our disadvantages and shortcomings. As a student of Senior high, I can do my own part. Although I can’t transform our city into more a beautiful place on my own, I can help Beijing in small ways and encourage our classmates and people around me to follow my lead.

It can’t be improved in a day or two. It takes time and energy. 前两节是语文课，语文老师拿着课本走进班里，我们把语文课本拿出来，开始上课。时间犹如金钱，一分一秒地过去了，转眼间，两节语文课就结束了。后两节是数学课，我们等待着数学老师进班上课。数学老师走进班里，满脸微笑，此刻的数学老师就像辛勤的蜜蜂刚采了蜜一样高兴，老师说：“同学们，今天我们来上一节有趣的课，请同学们把课本……”

一听是一节十分有趣的课，我们都兴奋起来，打开课本，开始看今天将要学的内容。老师讲着课，我们认真地听着，过了一会儿，老师说：“好了，现在我们已学习一部分内容了，那么我就要给大家出几道题，请同学们开动脑筋，认真思考。”说罢，老师便在黑板上唰唰地写了起来，老师写着，我们做着，不一会儿，我们就做完了。

这时，老师挑了几位同学上来演板，想看看他们会不会做题，演板的同学做完后，我们便开始一一对照，都确认没有错题了，这时，一位男同学举起了手，说：“老师，其实这道题还有一种做法，我们可以先……”我们听后，议论纷纷，都在说：“是啊，我怎么没想到这种做法呢?”

过了一会儿，教室里鼓起了掌，掌声淹没了说话声、笑声，教室里安静极了，老师也说：“对对对，这位同学说得很对，我们应该向他学习，学习他的创新!”那位男同学不好意思地坐下了……

创新的力量可以使一个时代变为荣耀，可以让一个国家有更好的发展，创新，它犹如一双手掌，塑造着我们的未来!

生命如风

好一个亘古的比喻。你也许感慨于它的来也匆匆，去也匆匆，不着一丝痕迹;我却跋山涉水，在时空里淘尽沙砾，找到了这个比喻的真谛

唯有风，可以穿越荆棘。

狄金森把人生描绘成篱笆墙的内外，我们一层又一层地爬过。事实上，这层层篱笆缀满荆棘，我们通过时，往往遍体鳞伤，身心俱疲。这时，你看到，风在墙外千萦百折，不屈不挠地呼啸而过，空气中凝结下壮观的痕迹。

我们趋行在人生这个亘古的旅途，在坎坷中奔跑，在挫折里涅NB021#忧愁缠满全身，痛苦飘洒一地。我们累，却无从止歇;我们苦，却无法回避。烈日暴雨来过，飞沙走石来过，我们布满伤痕，却还要面对一片片荆棘的丛林。

梭罗说：“这儿可以听到河流的喧声。那失去名字的远古的风，飒飒吹过我们的树林。”或 许回首远古，能把生命如风

苏轼看见了风。这个曾经辉煌的文人，因黄州诗案而开始落魄，流落四方，辗转难安。在赤壁的月夜，他心灰意懒，看“江上之清风，山间之明月”，做他那个神鹤翩跹而舞的梦。面对如江水般深沉的失意，他看见风在山顶呼啸，盘旋，然后带着撕身裂骨的阵痛穿越漆黑的荆棘林。刹那间，他心中郁结的块垒，缠绕的苦痛随风而散。挫折，痛苦，唯有忘记。

顿悟。

于是他逍遥红尘，寄情山水，最终文名垂千古。只是，那夜的风，已遗落于岁月，无人见得了……

梵高看见了风。他在向日葵田地中懒散地躺着，纠结于一个难解的疑问与痛苦：耗尽心血的画作，竟是一幅也无人理解，一幅也卖不出去!对于一个把艺术当生命的人来说，无人欣赏自己的艺术好比无人重视自己的生命，这是一种被轻视、被鄙弃的巨大痛苦!这是一个人生命中最大的挫折!

幸而他看见了一阵风穿过向日葵田地。那阵风被阻挡了，发出愤怒的吼叫。然而它们向前!向前!全然不顾被招摇的枝干划破身躯，它们成功了。

于是他也成功了。

《向日葵》等画作在他死后不久，直至今日，都是价值连城的稀世珍品。

在风吹着号角越过一座又一座沉默的荆棘林时，相信很多睿智的眼睛已经看到它在昭示着什么。

唯有风，可以穿越荆棘。

唯有学习风，我们才能藐视一切挫折，让痛苦烟消云散，让快乐洒满旅途!
