“我所掌握的，有名有姓，有身份证号码、联系电话的，仅在上海就有150个人。”毕业于上海东海职业技术学院的小王，是这群学生中的一名，如今的他，在找工作之余的另一项重要“工作”，就是收集被骗人信息，并牵头维权，“全国群里，有355个直接受害者，涉及济南、西安、成都、北京等城市;上海群里，我所认识并当面见过的人，有40多人”。

中国青年报·中青在线记者日前加入这一名为“维权英勇者”的微信群中，群里的维权大学生几乎拥有相同的“被骗经历”，所不同的是“骗”他们的企业。

最令大学生们伤神的，早已不是“为什么被骗”“被骗多少钱”的问题，如今，他们最关心的话题只有一个——如何维权。过去的半个月内，以小王为首的这群大学生，找过公安、工商、法院等单位，均未获得实质性帮助，略显尴尬的是，他们最终只能通过媒体维权——消息从记者处获得，律师通过记者聘请。

“极简”诈骗模式，如何获得“人心”

去年9月，小王在网上看到一则招聘广告——提供一份月薪6000～8000元的工作，前提是要接受为期两个月的岗前培训。

实际上，类似的“岗前培训”骗局，小王不是没听说过。因此，他在递交简历后，特地观察了这家公司的相关做法是否有文书“备案”。

在位于上海嘉定的上海圆享科技公司，小王签订了一份《SAP管理业务咨询服务协议》，协议约定在培训期间，公司每个月给小王4000元补贴，培训合格之后正式入职，每个月工资6000元，但是培训的费用19800元必须由小王自己承担。

但这份协议的落款盖章，却是“北京圆享科技有限公司”。小王当时对此也持有怀疑，对方告诉小王，这是“北京总部”的章。

此外，考虑到还没参加工作的小王一下子拿不出19800元，公司“贴心”地为其联系了“么么贷”贷款。

这是一个互联网贷款平台，是米么金服(小米科技投资)旗下的核心产品，专注为年轻人提供“当月花，下月付”的分期支付服务。公司资料显示，“么么贷”已开展教育培训、IT培训、职能培训等多行业商户合作，且风控体系领先。

在公司的运作下，小王拿到了自我感觉接近“VIP待遇”的贷款——6+18还款模式，前6个月每月还款198元，后18个月每月还款1311.04元。只不过，年利率高了一些——23%。

更“贴心”的是，前6个月每月198元的还款，公司承诺由公司来还。

3月25日，是小王原定的“结业日”。按照此前公司与他的约定，他理应在这一天拿到自己SAP(HR)人力资源管理结业证书，并且，开始享受由公司提供的“企业人才输送服务”。

但这一天，整个公司除了小王等学员外，只有一名负责的培训老师。结业证书是拿到了，然而，公司却不见了。

小王致电此前与自己联系的工作人员，对方声称自己已在年前调往北京工作，并给他一个名叫Eric的上海员工电话;Eric则告诉小王，公司已经从上海嘉定搬往宝山，“事情太杂乱，到4月初再安排”。

不到一周的等待中，小王渐渐察觉有些不对劲，原本在学员群里与学生互动火热的指导老师Cain不作声了，给Cain打电话，对方却说自己辞职了，此后便失联了。4月初，所有与上海圆享科技公司有关的人员全都失联，位于嘉定的公司地址空无一人。

中国青年报·中青在线记者了解到，上海的维权大学生，几乎都与小王有着同样的遭遇。涉及的上海圆享教育投资有限公司、上海启屹信息科技有限公司、上海兰石商务咨询有限公司，全部人去楼空，目前处于失联状态。其中，除兰石公司地址在上海市黄浦区外，另两家公司均位于上海嘉定区。

值得注意的是这些公司招收的学员，最后的汇款对象都是“圆享教育”。

学生集体维权，四处碰壁

从4月初开始，最近两三周时间，感觉受骗了的学生开始尝试集体维权，结果是，四处碰壁。

小姚的遭遇，比小王更“惨”一些。小王至少拿到了一份SAP(HR)人力资源管理结业证书，而小姚则在接受4次当面教学后，回家开始“视频教学”。

他最后一次与指导老师接触，对方告诉他，如果要享受“企业人才输送服务”，需要自己准备材料。这份材料包括“十次面试录音”——即要求学员自己出去找工作，并面试10次，每次面试录音为证。

“这是存心为难我们，能面试10次，还要他们提供什么服务?”与小王一样，现在小姚不得不面对每月1300多元的还贷压力。受骗者们最终决定报警。

4月5日，小姚、小王等3人一起到位于上海市公安局黄浦区公安分局报案，接待民警要求他们前往工商局找出公司背景。3人在得到相关文件后又赶回黄浦公安分局，却被告知该案属于“协议违约”范畴，民警建议同学们到黄浦区人民法院走诉讼渠道。

中国青年报·中青在线记者了解到，由于小王等人是与“北京圆享”签订的合同，因此，他们无法在上海嘉定主张权利;但以小姚为代表的一批被害人，与注册地为上海黄浦区的上海兰石公司签订了合同，因此，学生们决定就近在上海黄浦区维权。

在黄浦区公安局的建议下，受骗学生又赶到黄浦区法院。

小姚说，法官在认真看完合同和此前媒体播出的有关SAP培训诈骗的电视后，建议同学们通过公安局进行刑事立案，“还有一种做法，可以去北京申请民事诉讼，因为是北京公司盖的章。但这样做对公司没有任何影响，因为找不到被告人所以不管是案件还是赔偿都执行不了”。

受骗学生在集体商议后，确定了“走刑事立案程序”的办法。

4月9日，为了引起公安机关的重视，17名学生组团前往上海市公安局报案，但最终因为市局没有案件受理点，又被介绍回到黄浦区公安分局。

小姚将当时与黄浦区公安局相关工作人员的对话记录了下来。

黄浦区公安局：“你们这个我们审核下来不能被定为刑事犯罪。”

学生：“可是他们没履行合约啊!”

公安局：“你们参加培训了吗?”

学生：“没参加完啊!”

公安局：“他们有培训就不算诈骗，这算消费纠纷，你去消费者协会去告吧，我们没有调查权。”

学生：“那公司跑路了呢?”

公安局：“公司的注册信息还有吧?”

学生：“对。”

公安局：“那只能算他们暂停营业，要不你去工商局告。”

学生：“那您说怎么才能立案呢?”

公安局：“这个事情到法院去。”

学生：“可是我们已经去过了，法院说只能是民事诉讼。”

公安局：“你去诉讼，接下来法院如果判断出这是诈骗行为，会出具相关文书，要求公安机关办理。”

学生：“那能不能您给签一个不立案的决定证明?”

公安局：“立案有个审查期限，最后通不过还是通不过。你不如省点时间直接去法院吧，我们只管刑法上面的，你自己去看看刑法。”

媒体、律师介入，方获关注

4月22日，小王告诉中国青年报·中青在线记者，他们已经通过上海一家媒体找到了律师戴佩清，并在律师的帮助下，开始规范地收集证据。

戴佩清告诉记者，她认为目前应当做的是统计清楚这起陷入“贷款门”学生的具体情况，“到底多少人受骗、涉及到多少金额，确认一下哪些人付了多少钱，把他们的手机号码、身份证号码列表，到时候一旦有需要，我就把这个表交上去，让他们断定”。

就戴佩清目前了解的情况，“有些学生做过培训，法律上说‘未遂’，还没形成实际损失，不能说签了合同就是受害人。所以黄浦公安那边我也在沟通，他们需要研究一下才给我答复”。

小王告诉记者，黄浦公安方面原定于4月22日晚上给出答复，但截至记者发稿，黄浦公安局方面尚未就此给出答复。

“派出所办理的都是一般刑事案件，比如打架、斗殴等，此事件为经济类的犯罪案件，所以，派出所不立案是合理的;但是公安经侦部门不立案就不对了，事件中的兰石公司涉嫌诈骗，属于经济类犯罪案件，公安经侦部门应该立案。”戴佩清此前在接受《上海法治报》记者采访时认为，公安经侦部门应当立案。

戴佩清告诉中国青年报·中青在线记者，要解决这个事情，“正常路径就是去报案，应该由公安部门出面解决这个问题，他们有侦查权”。

此外，她建议：“其实还是应该通过专业的律师，专业律师还要通过各种关系，把这些东西查清楚才行。我也在提供很多法律意见，尝试帮到他们。”

中国青年报·中青在线记者了解到，小王、小姚等150多人只是在上海地区的部分受骗者，《上海法治报》获得的一份由济南受害者小张提供的名单显示，仅“上海圆享”从2013年开始接收了超过2000人培训，遍布全国各地。
