独创须具有“最低限度的创造性”。虽然独创对于智力表达的创造性要求并不高，但文字作品仍须具有反映作者个性风格、展示文学美感或传递一定量信息的效用。如果一种表达过于短小，仅由少量字词简单组合而成，一般很难满足上述要求。此时，若将其作为作品加以保护，会不合理地挤占公众创作的自由空间，这与《著作权法》鼓励创作的立法目的相悖。
