2022年高考全国甲卷语文作文题以《红楼梦》中匾额题名的故事为引，其中提到了“借鉴化用”的手法。笔者由此联想：“借鉴化用”是否属于再创作?“借鉴化用”在什么情况下构成著作权法意义上的“改编”?若构成“改编”，“借鉴化用”的法律边界何在?

“借鉴化用”不一定构成“改编”

文学艺术领域的“化用”含义丰富，既包括借表达上的词句，又包括借思想上的文意或语境。但并非任何一种“化用”都能构成著作权法意义上的“改编”。

事实上，后人的创作总是站在前人的肩膀上，难以避免地要利用前人的思想成果。倘若将思想私有化、垄断化，会打击创作热情。因此，“改编”作为《著作权法》中的术语也只讨论表达上的借，而不纠结思想上的借。换言之，“改编”须以原作的基本表达为创作基础，如果后作与原作在表达上已不存在实质性的相似，只有思想上的相似，那么此时后作可能构成“独创”，而不再是“改编”。在“泻玉”一题中，“泻”字虽取自欧阳修的“泻出于两峰之间”，但只拈出了其中一字，难谓是原作的基本表达，而更多的是承载水流飞泻而下之意象。

新增独创性表达的“化用”构成“改编”。《著作权法》保护的是智力成果，独创性则是人类精神文明之花得以绽放的智力源泉。根据我国《著作权法》第十条的规定，改编权是指“改变作品，创作出具有独创性的新作品的权利”。这意味着改编不是毫无门槛，而是要在原作的表达基础上进一步进行独立的创作，且新创作的表达须拥有最低限度的创造性。

反之，如果新增表达不符合独创性要求，则其整体仍属于对前作的复制，不构成新的改编作品。就“泻玉”二字而言，摘“泻”添“玉”，虽传达了创作者以玉比水的联想，但是表达太短，难以完整且个性化地展现创作者的思想情感、文艺美感或是传递一定量的信息。故“泻玉”之匾额题名难谓新增独创性的表达。

构成“改编”不一定属于合法“改编”

改编判断独立于侵权认定，构成改编亦可能涉嫌侵权。是否构成改编属于作品判断，只要后作相对于原作具有一定的独创性，即可构成改编作品，而改编行为是否侵犯他人著作权则是侵权认定。改编者在曾接触过原作的条件下，如果未经原作著作权人许可使用原作的表达，且增加了新的独创性内容，在作品判断层面，新作完全可能构成改编作品;在侵权认定层面，改编者仍然会侵犯原作著作权人的复制权和改编权。

改编的法律边界不仅限于尊重原作者改编权，还需尊重原作者的保护作品完整权。保护作品完整权属于著作人身权，是指保护作品不受歪曲、篡改的权利，而改编必然涉及对原作的改变。此时，二者便可能发生冲突。为平衡原作者的人格利益与文学艺术的创作自由，实践中要求改编人的改编须控制在合理的限度之内。

具体而言，改编人在主观上不能带有贬损原作或原作者声誉的故意，在客观上没有造成原作或原作者声誉受损的结果。因此，改编人应尽量在事前与原作者协商，明确改编权的行使边界，以最大可能降低侵权风险。

综上所述，“泻玉”式创作，尽管没有直接复制，在一定程度上体现了创作者的努力和创新，值得提倡。但是，“改编”不是简单的小添小改，而是需要满足独创性的要求，且须尊重原作者的复制权、改编权与保护作品完整权。社会主义文化事业需要新内容、新血液，一方面应鼓励改编创作，在继承中创写新的诗篇;另一方面也应注意权利行使的边界，在合法、健康的环境中培养可持续的创新。

记得有一次下课，我找他去玩。我发现他正全神贯注地看着书，手里的笔“刷刷”的挥动着，算着一道道数学题。我在他旁边一声不吭的站着。忽然只见他的笔停住了，皱起眉头嘴里小声的念着：“这道题该怎么算呢?”我见他百思不得其解的样子，便把脑袋凑过去，看看是什么难住了他。我看了之后，才知道他被一道应用题给难住了。我就和他讨论起来。上课铃响了，我们还没得到一个完整的答案。我于是劝他放弃，他不愿意，反驳我道：“这只差一点就成功了，我一定要把他算出来。”我回到座位上准备上课。下课了，只见他一溜烟的跑上讲台，和老师轰轰烈烈地不知道在谈些什么。我便上去凑热闹。原来，他在和老师讨论那道题。最后，老师给了他一个正确的答案，并给了他做了详细的解释。他那种坚持不懈的精神使我受益匪浅。我在一旁暗暗地为他竖起大拇指。

他不止坚持不懈的精神值得我学习，他那种不服输的精神也值得我学习。

开学的时候，老师对我们进行了一次摸底考试。成绩发下来后，我是全班第一，他的名次在我之下。他不服气的对我说：“我下次一定考比你多的。”结果，事情正如他所说，他比我多了两分，那全是他努力的成果。通过这次考试，使我比以前更加敬佩他了。

这就是我最敬佩和最好的朋友。

今年最难忘的就是元宵节了，那天的天气不怎么好，但街上人山人海，大街小巷都挂着五颜六色的灯笼，真是美丽极了。

Graduation and Moving on

Graduation is a time when we move on, from school to university, or out

into the real world.

Before graduating from school, We usually have a variety of activities,

However, I have mixed emotions about moving on.I want to stay and have more

I was born in America and stayed there for four years.

But after I celebrate my four years old birthday, my parents decide to go back to China.

Going back to China, I meet many difficulties. The biggest difficulty for me is to learn Chinese.

其实，春有很多种。我心目中的春种类繁多，正如我复杂的性格。安静时，我心目中的春如雨巷丁香；活泼时，我心目中的春如一枝红杏；思考时，我心目中的春如四月芳菲；嬉闹时，我心目中的春如戏蝶时舞。万紫千红总是春，春意浓淡皆为美。只因为，那些颜色，属于青春。

我是一个可爱的小姑娘，从小就与画画结下了不解之缘。

记得我刚上幼儿园时，看见老师在黑板上用神奇的笔画出了许多非常美丽的东西，我当时就迷上了画画。

在幼儿园老师的心里，我已成为了一个画画的小天才，每一次老师让我们展示自己的画时，我都是第一个把画高高举起的人。每次都会得到老师的赞赏，每天一画画我就兴奋不已。

到了四岁，妈妈爸爸也已看出了我画画的本领，决定让我去专门学画。我刚上了第一节课，就看出我跟其他的小朋友比起来真是不值一提。于是我下定决心，总有一天要比他们强百倍!

慢慢地，我熟悉了那里的环境，开始了我真正的学画旅程。

几年过去了，我上了小学二年级，我画画的本领突飞猛进!那时我在爸爸妈妈眼里成为了一名小画家，在学校里也是美术课代表，画黑板报呀，做班报呀都是我来负责。在美术学校里也是个“小明星”。

在家里我不知道哪一天想到了一幅好作品，就陶醉地画起来，眼看着一大堆A4纸被我用得所剩无几。而家里的桌子、柜子、书架、学习桌还有电视柜里全堆满了我的画。我就这样，天天画着，好像有谁对我施了魔法，让我如痴如醉地画下去。

我从小孩子画的线描画逐渐升到了油画，再经过学习升入速描。现在我再也离不开画画了。

对我来说线描画天真可爱，而水墨画博大沉重;卡通画细致美丽，而油画大气入境。画画对我来说就是鸟儿在天空飞翔，鱼儿在水中游来游去，绵羊吃着香草，船儿在海中航行。我希望不管我在哪，都有画伴随着我，我要永远与画做朋友!

Today ,my mother and I cleaned the house. I cleaned the windows hard because

it is so dirty. Then I cleaded it again. After that, I cleaned the floor and

swept it. I thought it is dirtier than windows. Then I cleaned the tables and

lots of chairs. We washed all of the clothes and quilts. Until four o`clock, we

tidied all of the rooms up. My room was the cleanest and brightest. I was so

happy and satisfied. Then my mother said: "You`re successful."
