If a citizens complaint is justified, the Ombudsman will act on his behalf. The action he takes varies according to the nature of the complaint. He may gently reprimand an official or even suggest to parliament that a law be altered. The following case is a typical example of the Ombudsmans work.

A foreigner living in a Swedish village wrote to the Ombudsman complaining that he had been ill-treated by the police, simply because he was a foreigner. 近日，国家卫生计生委宣传司司长毛群安说，中国目前已经有近20个城市制定了公共场所无烟的法律法规，全国的公共场所控烟条例正在立法进程之中，有望今年公布实施。

在北京、上海等地已执行的“最严禁烟令”将有望推广全国。规定在公共场合违法吸烟行为将承担法律责任，是立竿见影的禁烟手段。立法之后，立案和惩处随即跟上。群众也普遍认为，具体到执行，那一纸为禁烟而开出的罚单，不啻是执法公器的威力显现。

用罚单来对禁烟令进行量化参考，是大众化的口径。相关部门也以此来现身说法。今年4月，北京市卫计委在《北京市控制吸烟条例》实施快满一年之际，发布数据展示禁烟成果。成绩单显示，有376家单位因整改不到位被行政处罚，劝阻违法吸烟3322人次，有1331人被处罚，共计罚款105.47万元。

罚单数量并不能等同于整个北京市在这一阶段违法吸烟者的真实数量，公共场合依然故我的吸烟者，远远不至于千人。其中原因，有执法监督力量的人员不足，也有信息对称和宣传引导的边际效应，还有烟民素质的有待加强。“最严禁烟令”公布之后，市民的抱怨之声也时有泛起。他们在“有盖、有顶”的公共场合还是被尼古丁滋扰，而惩处吸烟者的罚单却迟迟未到。

如果单靠罚单未必有此成效。公共卫生领域的保障，靠惩戒只是治标，要治本还是要靠公民素质的养成。而当禁烟立法成为契约精神的首要，一种正能量随即产生，就有可能对吸烟者产生压力。就这点而言，禁烟令的全国性出台，实在是太有必要。
