大家好!又是一个清明节，又是一个缅怀和拜祭先人的日子。今年清明节放假，是根据上级部门的工作安排，由4月4日至4月6日，共三天。近一段时间以来，各处修路的、施工的、烧纸祭奠的人很多，非常容易导致意外伤害或火灾等事故发生。因此，安全问题要引起大家的高度重视。为了让大家过一个平安、祥和、愉快的清明节，在放假前，学校再一次对全体同学进行清明节假前的法制安全教育，具体要求同学们做好以下几点：

实施近五年即大修，建立最严格食品安全监管制度

我国食品安全法是2009年6月实施的，面对食品安全的严峻形势和公众对食品安全的期待，实施近五年就迎来了首次修改。新法共10章154条，与现行法律的10章104条相比，修改内容非常多。新法案经全国人大常委会第九次会议、第十二次会议两次审议，三易其稿，被称为“史上最严”的食品安全法。

现行食品安全法实施近五年来，对规范食品生产经营活动、保障食品安全发挥了重要作用，食品安全整体水平得到提升，食品安全形势总体稳中向好。然而，食品企业违法生产经营现象依然存在，食品安全事件时有发生，监管体制、手段和制度等尚不能完全适应食品安全需要，法律责任偏轻、重典治乱威慑作用没有得到充分发挥，食品安全形势依然严峻。

全国人大法律委员会副主任委员丛斌在向会议汇报食品安全法修改情况时说，党的十八大以来，党中央、国务院进一步改革完善我国食品安全监管体制，着力建立最严格的食品安全监管制度，积极推进食品安全社会共治格局。这次修改法律，正是为了以法律形式固定监管体制改革成果、完善监管制度机制，解决当前食品安全领域存在的突出问题，以法治方式维护食品安全，为最严格的食品安全监管提供体制制度保障。

在审议中，常委会组成人员对建立“最严格食品安全监管制度”集思广益，敢于碰硬，提出很多有建设性的意见建议，很多建议得到了采纳。

新修订的食品安全法通过后，全国人大常委会法工委行政法室副主任黄薇在新闻发布会上介绍说，新法对8个方面的制度构建进行了修改:完善统一权威的食品安全监管机构;明确建立最严格的全过程监管制度，进一步强调食品生产经营者的主体责任和监管部门的监管责任;更加突出预防为主、风险防范;实行食品安全社会共治，充分发挥媒体、广大消费者在食品安全治理中的作用;突出对保健食品、特殊医学用途配方食品、婴幼儿配方食品等特殊食品的监管完善;加强对高毒、剧毒农药的管理;加强对食用农产品的管理;建立最严格的法律责任制度等。

建立从田间到餐桌的全链条监管，让问题食品无处藏身

在审议食品安全法修订草案过程中，常委会组成人员表示，食品安全法修订草案三次审议稿着力解决现阶段食品安全领域中存在的突出问题，完善从田间到餐桌的全链条监管，应成为关键的内容。

车光铁委员在审议时说，从目前食用农产品质量安全管理情况来看，农产品质量安全法不仅未对食用农产品作出明确定义，监管标准也没有从安全性、营养性等方面区分于其他农产品，极易导致在食品安全监管源头上出现薄弱环节。他建议，将食用农产品统一纳入食品安全监管范围。新法将“食用农产品”定义为“供食用的源于农业的初级产品”，并规定:食用农产品的质量安全管理，遵守农产品质量安全法的规定，但是，食用农产品的市场销售、有关质量安全标准的制定、有关安全信息的公布和本法对农业投入品作出规定的，应当遵守本法的规定。

实现食品安全可全程追溯，是社会各界一直呼吁的问题。“如何才能实现食品及食用农产品的全程追溯?实行批次管理是一个有效的解决办法。批次管理是发达国家对包括食品在内的各类产品进行质量追溯和管理的通用的做法，我们理应加以借鉴。”在审议中，王明雯委员提出自己的建议。新法规定:国家建立食品安全全程追溯制度。食品生产经营者应当依照本法的规定，建立食品安全追溯体系，保证食品可追溯。国家鼓励食品生产经营企业采用信息化手段采集、留存生产经营信息，建立食品安全追溯体系。

“市场准入关，一定要把住。”刘振伟委员说，香港的蔬菜是内地供应过去的，但是香港的蔬菜是安全的，而我们内地的蔬菜不安全，差就差在检测上。供港的蔬菜在产地是要进行检测的，到香港进入批发市场之前也要检测，不合格产品，不退回就地销毁。新法规定:食用农产品批发市场应当配备检验设备和人员，或者委托食品检验机构，对进场销售的食用农产品抽样检验。进入市场销售的食用农产品在包装、运输等过程中使用保鲜剂、防腐剂等食品添加剂和包装材料，应当符合食品安全国家标准。

对农药使用、婴儿配方奶粉、网购食品等社会广泛关注的问题，新法作出了回应

利用剧毒农药、化肥、膨大剂等对蔬菜瓜果进行病虫害防治、催肥，是百姓最担忧的食品安全问题之一。

“既然不能完全禁止使用剧毒、高毒农药，能不能采用标注的方式?一方面老百姓有知情权，另一方面对它的销售有影响，迫使加快科技进步，尽早淘汰剧毒、高毒的农药。”在审议中，杨震委员这样建议。朱静芝委员则表示，剧毒农药如果继续允许使用，应规定剧毒、高毒农药不得用于蔬菜、瓜果、茶叶、中药材和粮食作物。新法规定:国家对农药的使用实行严格的管理制度，加快淘汰剧毒、高毒、高残留农药，推动代替产品的研发和应用，鼓励使用高效低毒低残留农药。禁止将剧毒、高毒农药用于蔬菜、瓜果、茶叶和中草药材等国家规定的农作物。

列席会议的全国人大代表宋心仿说，我国的食品添加剂乱用、滥用现象十分突出，在监管上几乎是空白。很多商家大量宣传食品添加剂功能积极的方面和作用，但对其负面作用却无人宣传，老百姓根本不知情。新法规定:国家对食品添加剂生产实行许可制度。从事食品添加剂生产，应当具有与所生产食品添加剂品种相适应的场所、生产设备或设施、专业技术人员和管理制度，并依法取得食品添加剂生产许可。

“目前我国婴儿乳粉的配方过多过滥，同意对婴儿乳粉配方实行注册管理。”买买提明·牙生委员建议。在审议中，吴晓灵等委员对此表示赞同。新法规定:婴幼儿配方乳粉的产品配方应当经国务院食品药品监督管理部门注册。注册时，应当提交配方研发报告和其他表明配方科学性、安全性的材料。

对新出现的网络食品安全问题，常委会会议组成人员积极提出对策。全国人大代表陈世春认为，按照法律要求，食品生产者是第一责任人，但是作为网络消费者不知道生产经营者是谁，而且也很难追责。所以，这个首责应该是网络第三方平台提供者。新法规定:网络食品交易第三方平台提供者应当对入网食品经营者进行实名登记。消费者合法权益受损，可以向入网食品经营者或生产者要求赔偿。第三方平台提供者不能提供入网食品经营者真实名称、地址和有效联系方式的，由网络食品交易第三方平台提供者赔偿。

保健品乱象一直也被社会广为关注。信春鹰委员在审议中指出，名义上保健品不得宣称治疗功能，但是实际上都隐含着治疗信息。保健品实际上损害的都是低收入阶层的利益。有调研表明，领退休金的群体最容易上保健品的当。新法规定:保健食品的标签、说明书不得涉及疾病预防、治疗功能，内容应当真实，与注册或备案的内容一致，载明适宜人群、不适宜人群、功效成分或标志性成分及其含量等，并声明“本品不能代替药物”。

严惩重处食品安全违法行为

治乱需重典，眼下关于食品安全的热点社会事件仍是不绝于耳，那么，新食品安全法是如何体现重典治乱这个理念的呢?

在新闻发布会上，全国人大常委会法工委行政法室副主任黄薇表示，新食品安全法通过法律制度的完善，进一步加大违法者的违法成本，加大对食品安全违法行为的惩处力度。

“一些违法者往往不怕罚，但是怕关，怕被抓。”国家食品药品监督管理总局副局长滕佳材表示，新法更好地体现了严惩重处原则，对违法添加非食用物质、经营病死畜禽、违法使用剧毒、高毒农药等屡禁不止的严重违法行为，增加了行政拘留的处罚。

全国人大代表陈泽民认为，此次修改食品安全法，建立了最严格的全过程监管制度，建立了最严格的各方的法律责任制度，而且对生产经营企业有了最严厉的处罚制度，对失职渎职的地方政府官员和监督部门也实行了最严肃地问责，对一些检验检测部门也实行了最严厉的追责制度。

滕佳材具体介绍了新法体现严惩重处原则的几个方面。

强化了食品安全刑事责任的追究。新法规定，对非法添加化学物质、经营病死畜禽等行为，如果涉嫌犯罪，直接由公安部门进行侦查，追究刑事责任。对因食品安全犯罪被判处有期徒刑以上刑罚的，终身不得从事食品生产经营的管理工作。

大幅度提高了行政罚款的额度。新法对违法行为处罚的额度大幅度提高。比如，对生产经营添加药品的食品，生产经营营养成分不符合国家标准的婴幼儿配方乳粉等违法行为，现行食品安全法规定，最高可以处罚货值金额10倍的罚款，新法提高到30倍。

对重复的违法行为增设了处罚的规定。针对多次、重复被罚而不改正的问题，新法增设了新的法律责任，要求食品药品监管部门对在一年内累计三次因违法受到罚款、警告等行政处罚的食品生产经营者给予责令停产停业直至吊销许可证的处罚。

对非法提供场所的行为增设了处罚。新法规定，对明知从事无证生产经营或者从事非法添加非食用物质等违法行为，仍然为其提供生产经营场所的行为，食品药品监管部门要进行处罚。

强化了民事法律责任的追究。新法增设了消费者赔偿首负责任制，要求食品生产和经营者接到消费者的赔偿请求以后，应该实行首负责任制，先行赔付，不得推诿。完善惩罚性的赔偿制度，在现行的食品安全法实行10倍价款惩罚性的赔偿基础上，又增设了消费者可以要求支付损失3倍赔偿金的惩罚性赔偿。强化民事连带责任，网络交易第三方平台提供者未能履行法定义务、食品检验机构出具虚假检验报告、认证机构出具虚假的论证结论，使消费者合法权益受到损害的，也要承担连带责任。

食品安全关系民众切身利益，如何严格严厉都不为过。在采访中，一些专家指出，新食品安全法虽被称为史上最严，但法规条款之“严”如何落实到执法层面，还需作出不懈努力。

活动形式：主要从四个方面来开展“清明节祭英烈”活动：一是浏览中国文明网;二是浏览异地学生发表的祭拜感言;三是师生发表祭拜感言(写征文);四、出“清明节祭英烈”专刊。

活动目的：首先是让广大教师重视这次活动，其次广泛宣传该活动的目的----深入贯彻落实党的“十八大”提出的弘扬中华文化、建设中华民族共有精神家园的战略任务。

活动要求：各中队辅导员(班主任)广泛宣传，发动有条件的学生浏览中国文明网页，发表祭拜感言，同时在三年级以上班级开展“清明节祭先烈征文活动”，三年级以上每班选出1-3篇优秀的上报学校少先队大队部，由学校大队部审查后发表在学校专题版面上(班级征文除了写出班级和学生姓名外，还要写出指导老师姓名)。

活动情况：

三、组织学生代表参加县里组织的“向烈士敬献花圈”活动。4月3日上午11：00，城关一小100多名师生代表在蒋建莉副校长的带领下，怀着崇敬而凝重的心绪齐聚烈士墓前，参加了由独山县文明办、团县委、县教育局、县关工委等部门组织的清明节纪念革命先烈活动，活动以“继承先烈遗志、珍惜幸福生活、立志报效祖国”为主题，活动中县城中小学约1000名师生代表以向烈士默哀三分钟、给烈士鞠躬、向纪念碑敬献花圈等形式祭奠为实现民族解放、国家富强和人民幸福而壮烈牺牲的革命先烈。最引人注目是活动结束时，城关一小少先队员们将自己亲手制作的小白花敬献烈士墓碑前寄托哀思，他们肃立在烈士墓前向烈士们表示：一定要继承先烈遗志、珍惜幸福生活、立志报效祖国。
