2002年12月，第九届全国人大常委会第三十一次会议审议民法草案。之后，由于物权法尚未制定，加之对民法草案认识分歧较大等原因，民法草案最终被搁置下来。2014年11月，党的十八届四中全会明确提出编纂民法典。2015年3月，全国人大常委会法制工作委员会启动民法典编纂工作，开始着手第一步民法总则制定工作。2016年3月4日，十二届全国人大四次会议副秘书长
