Duanwu Festival (端午节， Duānwū Jié) is a traditional Chinese festival held on the fifth day of the fifth month of the Chinese calendar. 3、新华社北京6月1日电 北京市人民检察院官方微博“北京检察”1日发布，日前，北京市昌平区人民检察院完成对“雷洋涉嫌嫖娼被民警采取强制约束措施后死亡”线索的初查工作，认为符合立案侦查条件。

根据办案的实际需要，北京市人民检察院决定，将该案交由北京市人民检察院第四分院立案侦查。2016年6月1日，北京市人民检察院第四分院依法决定对昌平区公安分局东小口派出所民警邢某某等五人进行立案侦查，按程序通知家属。同日，北京市有关检察机关控告申诉检察部门还向雷洋家属吴某某通报了检察机关办理案件情况。

公众关注“雷洋案”，不只是在意公共安全是否存在，更在意实现正义的法治信仰会否动摇。“努力让人民群众在每一项执法活动、每一起案件办理中都能感受到社会公平正义”，依法治国才有坚实基础，办事依法、遇事找法、解决问题用法、化解矛盾靠法，才能成为全社会的遵循。

“人民日报评论”微信公号1日刊文称，“雷洋案”又有新进展。北京市人民检察院权威发布：6月1日，该院第四分院依法决定对涉事民警邢某某等五人进行立案侦查，按程序通知家属。雷洋案的辩护律师对此评价，北京市检察院接受报案，及时立案，让每一个案件当事人都感受到法律的公平正义。

正义不仅要实现，而且应当以人们看得见的方式实现。从及时动态公开案件信息、委托第三方进行尸检，到北京市公安局“绝不护短”的表态，再到市级检察院立案侦查，人们从中看到执法机关推进公开透明、夯实法治信仰的决心。

程序正义体现了法治与人治之间的基本区别。尽管尸检还在病理检验阶段、结果尚需等待，尽管侦查还需时间，但要认识到，在依法治国的语境下，证据的采信、事实的认定必须经过法定程序，“雷洋案”正沿着法治程序的轨道一步一步走向真相与正义。在此“空窗期”，让我们耐心等待，积极监督，将对这一案件的关切汇入对司法公正的推动。

对于社会来说，每一起争议案件，都是一次普法教育;每一次依法解决，都是一个推进法治建设的契机。透过这起引发多元舆情的个案，一个法治共识值得珍视，即对确有执法过错的，要严格依纪依法处理，决不包庇决不袒护;对恶意造谣，以虚假信息扰乱视听、诋毁民警依法履职的，要及时澄清、依法查处，坚决维护法律尊严和执法活动的严肃性。无论是案件的处理，还是公安的执法，回到法律程序的轨道上，才是法治的胜利。

2、公安部：确有执法过错要严格依法处理。

综合新华社电记者1日上午从公安部官网获悉，5月31日公安部召开的部党委会议对公安机关执法工作做出指示。会议提到，对涉警舆情，要高度重视，实事求是、客观公正对待，积极回应社会关切;对确有执法过错的，要严格依纪依法处理，决不包庇决不袒护;对恶意造谣炒作民警依法履职的，要及时澄清、依法查处，坚决维护法律尊严和执法活动的严肃性。

从官方发布的信息中了解到，公安部将派出督察组对各地公安执法工作进行专项检查督察，及时发现、纠正执法突出问题，推动执法规范化建设向纵深推进。

会议强调，各级公安机关要牢固树立执法为民理念，切实增强法治观念，认真贯彻落实《关于深化公安执法规范化建设的意见》，进一步规范执法标准、完善执法细则，强化对执法全过程的监督管理，使执法工作的各个环节都有章可依、有规可循。要加强对广大民警的教育培训，努力实现执法行为标准化，着力提升执法能力水平，切实把严格规范公正文明执法的要求落实到每项执法活动、每个执法环节中。

3、5月20日，中央深改组召开第二十四次会议，会议审议通过了《关于深化公安执法规范化建设的意见》。深改组会议强调，深化公安执法规范化建设，严格执法监督，解决执法突出问题。

这是一个重大信号。法谚云：“任何人不能做自己的法官。”对雷洋死因，昌平警方百般解释公众就是不信，就是因为雷洋死在警察手中，办案警察本来就是一方当事人，在缺乏充分证据的情况下，警察所在的公安机关指人嫖娼、自证清白，自然难以服众。所以公众呼吁具有公信力的第三方机构介入开展独立司法调查。虽然由昌平检察院审查此案，意思稍微差了点，毕竟昌平区检察、公安是兄弟单位，属于同一个机构领导，但与涉事公安的自我调查、自说自话相比，这已是一个进步。

所以，我们不妨稍安勿躁，静等昌平区检察院的审查结果。我国刑事诉讼法规定，检察院对于报案、控告材料，应当迅速进行审查，认为有犯罪事实需要追究刑事责任的时候，应当立案;认为没有犯罪事实不予立案的，也应将不立案的原因通知控告人。控告人如果不服，还可以申请复议。据分析，结合雷洋尸检结果，估计在6月上旬，昌平区检察院应该会公布结果，告诉公众对此事是否决定刑事立案。

其实，凭借现代侦查技术，只要检察机关认真进行调查，依法独立办案，比如通过侦查技术找到街头录像和执法时拍摄的录像，恢复被删除的手机视频，对办案警察分开询问，雷洋案是有可能查明真相的。记得当年浙江某地也发生一起被双规对象暴死案，一开始，办案人员订立攻守同盟，坚称死于意外。浙江省领导尊重生命，尊重法律，指定衢州市公安局异地独立办案，不久，谎言即破，真相大白，6名施暴者最后均被判刑。举此例子，并不是我认定昌平办案警察已涉嫌犯罪，但无论如何，由第三方独立查明此案真相，对生者对死者都是一个交代。

最近，不少杭州车主都遭遇过这类乞讨人群：拿着鸡毛掸子或一块抹布，抹两下车窗后，朝你鞠躬，等你给钱。一两元已经打发不了这些人了，车主不给钱他们就趴车头。杭州的“马路丐帮”一事引发热议，市民支招称，“别妥协，拿出手机取证”，管理部门则回应称“可报警”。(12月1日《今日早报》)

从频见报端的新闻来看，这些年，“强行乞讨”的事情并不少。有人一开始利用的是同情心，比如装成残疾人、或是抱着婴儿、亦或是打扮成学生模样，一旦你不给钱，就开始骂人恐吓;也有人直接来硬的，比如抱着你的大腿，拉着你的衣服，亦或像杭州这些乞丐一样，趴在你的车上，不给钱就不让走;还有人假扮成和尚、道士，利用宗教的力量来吓唬你……为了要钱，一些乞讨者的确已经达到“无所不用其极”的境界。

我国的法律，对行乞并没有明确禁止，这意味着，乞讨也是一种权利。不过，任何人发挥行乞权的同时，都不能侵害他人的权益，这是最起码的常识与底线。遗憾的是，类似杭州“马路丐帮”一般的行乞行为，则违背了最起码的底线，一则，强行乞讨给其他人带来不适感，并侵害了他人的财产安全与基本权益;二则，在马路上强行乞讨，不给钱不让开车，还有影响交通秩序、扰乱社会公共秩序的嫌疑;三则，乞讨没有错，但强行乞讨怎么审视都是文明城市的污点。

对于“马路丐帮”，法律并非无解。比如，根据我国《治安管理处罚法》的规定，反复纠缠、强行讨要或者以其他滋扰他人的方式乞讨的，可以处五日以下拘留或者警告。以此审视，杭州“马路丐帮”的当事人，完全可以拘留五日。可遗憾的是，法律是这样规定的，但执行却并不严格：一般情况下，只要没有引发社会强烈反响，或是引发重大交通事故，警方基本只会对“马路丐帮”进行警告，不会拘留。对“马路丐帮”的从轻处罚，就是一种间接的纵容。

从个体的角度来看，很多人遭遇“马路丐帮”，也基本上不会选择报警，而是选择妥协。一方面，一些人有事情要办，时间上耗不起;另一方面，因为“马路丐帮”索取的金额并不高，最多也就五块十块什么的，一些人便选择“花钱消灾”，懒得跟“马路丐帮”们一般见识，当然，也有人是害怕为几块钱较真让乞讨者采取过激手段，一旦“马路丐帮”是有组织的，那自己便可能吃不了兜着走。这些对强行乞讨者屈服的行为，是“马路丐帮”滋生的土壤。

当“马路丐帮”严重危害到公共安全，治理便应提上议程。对此，公众早有摇旗呐喊，即“动嘴”，但行动却是缺失的。因而，真要从根本上治理“马路丐帮”的行为，一方面，需要公众“动手”，当然，这不是要打架驱赶，而是选择报警，绝不姑息纵容;另一方面，则需要政府部门“动法”，不能再以批评教育为主，而必须以惩戒震慑为主。唯有全社会在共同努力，“马路丐帮”才能得到更好地整治，也才会“慢慢变少”。
